Do I notify USCIS?

I applied for K-1 in August 2021. We ended up deciding that we didn't want to go that route, moved to the UAE and got jobs, got married earlier this year in his country and now are preparing to apply for CR1. My question is, do I need to anything to notify USCIS that I want to withdraw K1 or do I just wait until they see I'm married based on his home country's records? Will doing nothing impact my application when I go to apply for CR1?

You'd want to write to USCIS and withdraw the I-129f petition. Simply state you're withdrawing - providing a reason is entirely optional. That way you have no loose ends. Address to send to is on your I-797 receipt.

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

How would they ‘see you’re married based on his home country’s records’?   That’s not how that works.

 

Withdraw the K-1 by notifying USCIS, and then you can petition him for a visa.

 

You'll also want to read up on maintaining domicile in the US.

@Jorgedig Pakistan has a national registry for marriage so I wasn't sure if they check that. 

 

I will notify USCIS. 

 

As far as maintaining domicile, I work for a US company over here in UAE, still use my US bank account & driver license and will return to the US soon to give birth to our child. But I still look into it more. Thanks
