I've seen that the new I-134 Form requires the past year of tax return from the beneficiary, I've been an unemployed student for the past few years so how do I get tax returns for myself? I'm really worried as I haven't earnt enough money above the threshold to get a tax return? Thank you

This form has many uses. What is your situation? Are you trying to get into the US at the border seeking asylum or refugee status? Are you in the UK and somebody is sponsoring you for a visa? What visa?  Filling out a timeline would be helpful. 
 

The answer depends on your situation. Please give some more info.

The answer depends on your situation. Please give some more info. 

I'm in the UK and my US fiance is going to sponsor me for our K-1 fiance visa, sorry for missing those details.

You must be confused.  The requirement is for the petitioner's tax returns and income documentation.

 

Plus, as a British citizen living in the UK, how in the world would you ever have a US tax return?

Yeah I am abit confused about that bit, I'm concerned about the evidence required for the "Beneficiary's Assets", I am unable to get a tax return so I was wondering if bank statements or any alternatives would be enough?

Great. You do not need a job or a tax return because you have somebody sponsoring you. Your fiancé will fill out the form. The important parts are the ones about the “Individual Agreeing to Financially Support the Beneficiary” where he will list his income. He doesn’t really need to  list his assets if his salary is over the required threshold. For proof of income for a K1 London, He should get an employer letter, recent pay stubs, or provide a tax return…whatever is easiest for him to provide. You don’t need all three.He doesn’t need a bank letter unless he doesn’t have enough salary and needs to use assets to get over the threshold.  You in the UK provide nothing.

There are no requirements for beneficiary's assets.

Okay I understand better now, does this mean I can skip that information on the form then? His income is also above the threshold, thank you for the help.

The I-134 (and later the I-864) is to be completed by the petitioner, and any joint sponsors.  It is used to determine the beneficiary's risk of becoming a public charge and the petitioner's ability to support the beneficiary financially.

The petitioner's (my fiance) income is more than above the threshold, there is a section in the I-134 Form about the "Beneciary's Assets" can I skip this part if he's above the threshold?

This is odd.  Why are you filling it out?  Your USC fiance needs to fill it out.  He should be the person asking questions.  He is the one who needs to sign.  He needs to agree to support you, the beneficiary, and provide the proof of income to satisfy the CO at London that you are not at risk of being on public charge.

He will be filling it out, but I was just concerned about the 'beneficiary's assets' section when I've been unemployed. If it doesn't matter I'd assume he skips that section since he can provide for us (he's above the threshold)?

I assume the part that seems confusing is that it has the asset declaration section, and people think they need to fill it out.  But according to the I-134 instructions, page 4 and 5:

Page 4, Beneficiary's Assets:

Provide information about any assets available to the beneficiary for the anticipated period of his or her stay. List only assets that can be converted into cash within 12 months and that will be used to support the beneficiary while the beneficiary is in the United States.

 

Page 5, Sponsor's Assets:

Provide information about any assets you will use to support the beneficiary for the anticipated period of his or her stay. List only assets that can be converted into cash within 12 months and that will be used to support the beneficiary while the beneficiary is in the United States.

 

Reading carefully, both parties can list assets IF those assets will be used to support the beneficiary while he/she is in the US.  It is optional.  If income alone qualifies, asset information is not required.

Okay I understand better now, yeah I just assumed we'd have to complete every part of the Form, thank you for the clarification!
