Question on I-864EZ - worked abroad , no W-2

Hey all,

Question on the form I-864EZ. I have worked abroad for the last 3 years, two of which I didn’t receive a W-2 because I worked for a local company. I did file my taxes as a US citizen working abroad, but didn’t make enough to get any return. My current job is US-based and makes an approved amount to qualify for the form. I have not gotten my W-2 yet from my employer, since I started back in Feb of this year.  Any advice on how to proceed? I’m thinking of requesting a letter from my employer, proof of my annual salary with pay stubs from the last 6 months, and maybe requesting a W-2 early?

That is what you need to prove current annual income.  You cannot get an early W-2.  Besides, W-2s (which are issued after the calendar year) are evidence of what was earned last tax year, not what is currently earned.  Good luck.  Every day is another day closer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

provide your most recent   3 years of tax transcripts: 2021, 2020, 2019

that’s not a thing. The earliest you can get a W-2 is January 1, 2023. Besides which, W-2s document past income. You must accurately and truthfully accentuate your current income

Understand that current income is King.  Current income equals the amount of gross pay   that was listed  on your most recent  pay stub multiplied by the number of pay periods per calendar year.

Your question is about the I-864EZ.  You cannot use that.  You must use the I-864.  No need for an employer letter if you are a US employee of a US company.  One pay stub will do.  If you are a non-us employee of a US company, your income doesn't count until you become a US employee or have a letter stating your income will continue from the same source once you're IN the USA.
