Hello, 

Happy Friday, 

We mailed our Joint I-751 application on 09/01 via Fedex express, it was supposed to be delivered on 09/06, however, it didn't make. It was deemed lost two weeks after shipment; lost package claim was filed and approved. Since the original package was lost, we cancelled the check in the old package and built in a new package and mailed and it was delivered on 09/21. We received the 24 month extension letter (Nebraska Service Center) a week later and the biometrics reuse letter a week after that. We thought that was it and now we forget about it until it gets approved or we file for citizenship next year. However, I received a text from USCIS stating that my package was received  on 10/05 with a new receipt number that also starts with LIN but different digits. It would get rejected since the check is cancelled, I thought, but when I checked the online status it shows that it was accepted and a receipt notice is sent. Now, I have two pending I-751s at NSC. Can you please advise on what I can do in this situation? Should I withdraw one of them? I'm afraid that would cause more confusion.

Has USCIS cashed both checks?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

in my case USCIS usually produced the receipt letter (first) but then cashed the cheque 3 days letter. so i was wondering if this is false receipt because OP said the cheque was cancelled. probably take few days for USCIS to find out

 

OP if i were you, i will write brief chronological letter and attached both of the receipt letter to explain the situation

dont wait. send it now. send it to the service center at the bottom of your receipt letter. explain in detail

If you used cashier checks, you can't cancel them until 90 days has passed. If a cashier check is presented within 90 days of issue the issuing bank has to honor it by law. I would expect the bank to come looking for the 680 dollars they may have temporarily credit to you thinking it was lost, but deal with the bigger issue first, having 2 I751's running. Money is the least of your worries now.

 

Generally, a customer cannot order a stop payment on a cashier's check, and the bank must honor a cashier's check when it is presented for payment. This is because a cashier's check is drawn directly on the bank that issues the check, not on your account

I would check your first package tracking number and see if it was actually delivered. It should still be active in the system. And come Monday go to your bank and double check their rules, but they will have to pay it if presented within 90 days. Most of the time when you request a stop payment, they will inform you there is nothing they can do until 90 days has passed from the issue date. I can't believe they refunded your money and reissued a check before 90 days was up, or did this without informing you that they will cancel it and refund your money, but if the check gets presented within 90 days, they will want their money back( Basically they will take it from your account without you knowing until you check your balance). You could have got a new teller, or maybe they have a policy that allows you to cancel. If so, let me know, I'll open an account there. I use cashiers checks quite a bit, and am pretty familiar with all the rules that go along with them. Anytime I had to cancel one it took 90 days before they would credit money back to me unless I could produce the actual check, and hand it over to them. I'm sure if you check your banks policies on cashier checks it should explain it. You should be able to access that information at their website before Monday morning.

Hello everyone, I just wanted to provide an update on my situation to add closure. We decided to wait a little bit and see what happens before taking any action. USCIS caught up 10 days ago that the check was canceled and rejected the application. I received my package back from USCIS two weeks after receiving the 24 month extension letter. So to answer Loren Y, USCIS couldn’t cash out the cancelled check from Chase and had to reject the application. I’m glad it worked out at the end, thank y’all for your replies.
