You have to turn off "Java script" on Adobe, write what you want, turn it back on so that you don't screw up other sections.

 

It should be under "preferences."

So I saw this in the instructions of the I-129f.

 

"NOTE: You do not need to file Form I-130 on behalf of the child of a K-3 beneficiary in order for the child to obtain
a K-4 visa.
However, a K-4 nonimmigrant is only eligible to adjust to lawful permanent resident status if he or she is
under 18 years of age when you and the K-3 parent marry and you file Form I-130 petition on the K-4’s behalf before
the K-4 reaches 21 years of age."

 

Do I still need to file an I-130 for the child as well or is there some loophole here where I can get my wife's 16 year old son to come on a K4 along with her? If I read this right I can file the 130 after he arrives.

 

Is there anything special I need to file for this?

 

If this is the case can we delay his entry for a bit before we bring him here?

Why is it that the "K-3 Spouse Visa Process & Procedures" seems to be a sub-forum of this one but I don't see where you can click into it, like a stickied thread or something. In fact I am not exactly sure how I stumbled upon it but I am glad I did.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

The most important thing to know about the K3 visa is that it's virtually unavailable.  Has been for more than 12 years.  You can try filing the I-129F for spouse after you have your receipt notice for the I-130.  Sometimes that gets the I-130 pull out of line and approved early.  Doesn't cost anything but your time, but there will be no K3 visa.

Facts are cheap...knowing how to use them is precious...

Doing it the correct way leads to getting the process done faster.   Stream across the border (ie without inspection) and you end up having to leave the country for an indeterminate time to process the visa and a waiver.   It is not a fun or cheap process.  Do it the correct way and there is a chance the steps after arrival go as fast and easy as ours.

Another poster asked if you filed online.  Your answers help us to help you.  If you filed online then a receipt should have been generated that day.   File a request. (won't go into the the details but it is an automated process but hiccups occur with credit card processing.)  If you filed by paper and didn't do anything like staple, strap, put in a note book or include miscellaneous un needed items then file a  request for the receipt.   If you did staple or similar then you just wait for the lowest bidder contractor to have time to get to the pile of items to be manually scanned. That can be over a month.

 

I've helped out at an immigration clinic in the past and I can tell you that those who entered incorrectly have tons of heartache trying to fix things - well at least in the recent past.  I can also tell you knowing someone that did a k3 nearly a decade ago that it takes the worst things from a spousal visa and mixes it with worst things from a k1 visa.  The brief 2019 occurrences of K3 speeding up I-130 approvals seam to have ceased but since it is free to try feel free to move ahead once you have the receipt number issue resolved.

 

It is a long process but understanding it end-to-end and have patience is the only solution.   In US Immigration the more urgent you want something makes anti-karma  occur in the process.

You won’t get a K-4, because your wife will not get a K-3, as folks have been telling you in your various many threads.

 

If you want to bring your stepson here, you can petition him using the I-130.

Because no one has been issued a K-3 since like 2013.

If they are not issuing them anymore then why is it even on the site anymore? That doesn't even make sense.

You are in your right to question the insanity of it.

They do still accept K3 applications but they'll never approve it. They'll just hold on to it until the I-130 gets approved, and eventually send you a letter that stating that oh BTW your I-130 has been approved so we have to deny your I-129F K3.

I have heard in some circles on here that filing K3 helps push the I-130 along a bit faster but personally I find it speculative. In any case if you can try your luck with filing K3 to see if pushes the I-130 forward; it costs nothing but time. Good luck.

Don't count on the I129F doing anything other than possibly speeding up the I130 processing, so make sure you file the I130 for the step-child as the K3/K4 will more than likely never materialize.
