Brother on B2 visa(In USA) and the USC can apply for him?

Timeline

Really sorry If I am in wrong forum

 

My brother has B2 visa, he visited back in 2018. That time I am not USC 
In 2020 I got my Citizenship and I am wondering If is there any way, My brother can come on visit visa and I can apply for him or he can stay legally. (Is there any way ? )

I do know If I will apply for immigration it will take around 12 to 15 years.

You can petition him, and it will take closer to 20 years.

 

He can visit on the B-2, but not stay.  He can only stay for the length of time permitted (up to six months, often less).

There is no adjustment of status available for siblings of US citizens so he cannot stay here and wait for his visa to become available. He will need to wait in his home country for the process to finish. He can visit as a tourist but there is no way for him to stay here to wait out the process.

Well - he can adjust but only when he gets a visa number available AND if he is and always has been in legal status in the US. So it’s theoretically possible but he’d need to find another legal status (work visa as example)  to allow him to stay here for the next 15-20 years before he can get his green card. If he ever overstays or violates status in any way he is ineligible to adjust status based on F4.  So technically correcting you but same bottom line, he needs to go home and wait

  • after u submit the petition , understand that when he visits the CBP may not admit him when they check the system and see a petition for him to immigrate

But that is extremely rare for F3 and F4 petitions precisely because almost no one can adjust from them. I visited the US regularly while my F3 petition was in progress and never once got a question about it from CBP.
