No need to provide evidence of income when applying for Removal of Conditions?

To whom it may concern,

 

I apologize in advance if this question has already been asked in this forum. I did check several pages of the forum and did not see my question.

 

I'm the US Citizen. My wife came from China on a K1 visa in Sep. 2019, then we got married and applied for AOS in Oct. 2019. She had her interview and got her 2-year Green Card in Jan. 2021. Her current Green Card expires in late Jan. 2023, so we're preparing to file her I-751 later this month (Oct. 2022).

 

When we submitted her AOS application in Oct. 2021, we included all sorts of evidence proving that I made the minimum income required in the Affidavit of Support.

 

I don't see anything related to proving income this time around with the Form I-751 and Removal of Conditions application. 

I just wanted to make sure that I'm correct in my understanding that evidence of income is not required at this step?

 

(As a side note, I do plan to submit tax transcripts and bank account statements with our Form I-751, but those are for the purpose of showing that we're married, not for the purpose of providing income, right?)

 

Also, there are a number of documents which we've been required to submit in the past, and it's also my understanding that this time around none of the following are required:

  • Birth Certificates (both mine and hers)
  • Passport photos (hers)
  • Copy of my passport
  • Marriage Certificate
  • Police Report showing no criminal background
  • Evidence of vaccinations

Could someone please confirm that my understanding is also correct on this?

Not required for Removal of Conditions.  The previously signed I-864 is still valid.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yes none of these documents are needed for the i751 removal of conditions filing.

I urge you to go to the USCIS site with all the info needed to file an i751 application including the current i751 form, current fee needed, the address to send your spouse's application to, and much more needed information file an i751 successfully. https://www.uscis.gov/i-751 

 

With an i751 filing you need to show you have been in a bonafide marriage with your spouse since you got married.

 

1) You need to show you and your spouse live together throughout your marriage

Provide a lease or leases with each of you being listed on the lease or mortgage

Provide copies of state issued IDs with common home address (driver's license or state issue ID)

Provide some mail showing each receive mail at same address (provide mail address to both of you at common home address)

If needed get an affidavit from landlord that you both live together at your home.

 

2) You need to show that you and your spouse share finances that you support one another financially

File joint tax returns each year (obtain IRS tax transcripts for each year married and submit with i751)

Provide copies of bank statements from joint accounts showing shared income and shared spending throughout marriage

Provide joint bill statements over marriage (Utilities,  phone, internet,)

Joint insurance statements (car, health, life) 

401k or insurance beneficiary

 

3) Show you do thing together as a marriage couple

Have children, provide any birth record of children together 

Photos together at family event or on holiday together

Proof of travel together

Buying large ticket items together like a home or car.

Fingerprints reused October 2020, and February 2021 and June 2021 (Yes 3 fingerprint notices)

Case move to National Benefits Center December 2020 for quicker processing from California Service Center

Oct 2021 out of processing time inquiry made, response May 5th 2022 that our i751 case will be addressed at our n400 interview

Combo interview May 16th 2022, in Sacramento

Approved June 08, 2022

 

Filed for Naturalization May 2021

Fingerprints reused May 2021

Combo interview May 16th 2022, in Sacramento, 

Approved June 08, 2022

Oath Ceremony completed June 29th 2022

The Hijack posts were removed from your thread. Unless you prefer  totally non related questions over take your thread mixing up answers that have nothing to do with you. This is not Overzealous policing. It's keeping the forums smooth and not disorganized.
