Providing Future Address as Mailing Address

Hi y'all,

 

We are planning to submit our I-751 next week (~14 October) and it has all the documentation linked to our current address that we have in the form as "Physical".

 

We are also moving houses on October 25th and were thinking of using future Address as Mailing:

 

- Provide current Address as Physical

- Provide future address as Mailing

- Providing a future lease as part of our evidence documentation

- Provide "Additional Information" in I-751 for the Mailing Address checkbox explaining our situation

- On October 25th submit AR-11 & setup USPS redirect

 

We only have a lease for our new address, so we don't think it makes sense to wait till 25th while providing all the docs for old address either. Our due date is 11/19.

 

Are we doing anything wrong here?

Hi @RustyWind I would recommend using the information that is accurate at the day of filing the form. Not past or future addresses etc.

 

Just submit the paperwork once you're moved to the new address, especially since you have until 11/19 to file.

 

This would eliminate any issues with I-751 receipt getting lost. And you would not have to explain your address history to IO in the future (how come your form was filed using the address you weren't living at the time of filing)

Timeline

The 24 month extension letter is valuable and practically irreplaceable. Having the 24 month extension letter returned to sender because you don't live there yet would be devastating. Use a mailing address of a friend or of a mail box you control.

The extension letter is the reason we wanted to do that in the first place.

 

Would it be okay if all of our documentation is from previous address if we submit our i751 it right after the move? We would not be able to have new IDs, banking statements, etc in time

 

- move on 25th

- submit ar-11

- send i751 on 25th with new physical address

- all docs, but the latest lease are for previous address

Don't worry about that, just indicate you just moved in the cover letter. Give them a timeline of your address during the marriage; you can update them with additional evidence if you get an interview. You can provide the new lease or mortgage along with updated utility and other info you have on hand.

Submit the all current stuff and as much of the new stuff as you have at the time of filing.

 

I fear the USCIS and the post office misdirecting your notices more than not having all the latest evidence submitted.

If I were in your shoes, and knowing how USCIS and USPS each have an A+ in mixing addresses, I would wait to mail the package until you’re moved to your new place. Therefore, your physical and mailing address will be the same and there will be no confusion. 
I understand you’re worried about the evidence having the old address, but that’s not a red flag at all provided you explain in a one line in your cover letter. Something like 

“please note that most of our evidence included in this package has an old address of xxxxx since we lived there until x/2022. We recently moved to xxxxxx, as incated by the AR-11 we filed on x/2022”. Simple as that.

I would wait to file until a week or so before the expiration date on the green card and collect as much updated evidence as you have at the time.

 

I would propose you send i751 around November 10th 9 days before expiration that should give you time to update your proof at your new address. If you are buying a home together that would be strong  proof of a bona fide marriage. 

 

Submit all evidence from the old address (current IDs) and as much of the new address proof as you have collected at the time of submission (New IDs if you can get them).

 

Send the i751 overnight UPS or fedex to the correct address for your address filing from. Check https://www.uscis.gov/i-751-direct-filing-addresses

Check you are using the current i751 form

Check that petitioner has signed (green card holder) and the USA based spouse has signed the spouse section

Enclose the correct fee, i751 and biometrics fee together in one check or money order $680

Follow the filing instructions at https://www.uscis.gov/i-751
