File I-90 immediately. Don't sit with that card because it'll come bit you later

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Should We wait until my husband has a visa interview? We didn’t finish uploading documents or the application on ceac yet so should we wait until he is issued a visa?

This is independent of your husband's

There’s no I-90 to file. Husband didn’t even interview - yet to finish NVC and get interview. 
 

I wouldn’t worry until visa in passport and even then it can be fixed at POE.

u just file the I 130 

it will be CR1 if husband comes to US before 2 years of marriage

IR1 if after

 

Please fill out a timeline 

it helps to know what stage u are in so these questions can best be answered

and ID the country so we all know what embassy this is for

good luck to the 2 of u

My husband’s case is at nvc our i130 petition  was approved.

We married last September in 2021.

November we applied for the i130 petition 2021.

 September 1 2022 our petition was approved then about September 3 or 5 it was sent to nvc and we got email from nvc with our case number, which was fast.

 the nvc site I noticed it that it said visa class ir1

That "IR1" message doesn't have much meaning.  You do not need to specify it as IR1 or CR1 at this point.  At the interview the CO will check the marriage date and issue a CR1 visa or IR1 visa accordingly.

The visa, when issued, is typically  valid  for 6 months. 
 

You were married September 2021. If the visa is issued March 2023 or later then he should wait until your 2 year wedding anniversary to enter the USA. This way a 10 year green card is the correct process, and he avoids I-751.  
 

If the visa is issued before March 2023, then no point waiting, and he should enter the USA immediately. If he is issued  a 10 year gc, this is a mistake, and he can deal with that then by filing I-90. I would not file I-90 until I had a REAL ID state ID and an unrestricted social security card in hand.  Regardless he will have to file I-751 when it is time to do so.

Yeah everyone says he can get it fixed once he is here but maybe at interview they will give him the right visa class. Im sure these mistakes happen alot and some interview officers notice the mistake so he will be okay regardless.

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!
