Spouse visa from abroad or dv-l?

I am a US citizen with a Moroccan spouse and we'd like to apply for a green card. We live abroad (not in Morocco)

 

Married 6 years

 

2 kids

 

We applied for a tourist visa and it wasn't approved when we were first married, so we never tried again. This was in Morocco, we presented strong ties, but not enough apparently. My spouse has a good job and should complete his PhD in January, if that's important. 

 

Are any visas possible as we live abroad?

 

Should we enter the green card lottery, or is that even an option as I'm a citizen?

IR 1 would be obvious, you would need to be his sponsor and need to have US residency.

 

Yes he can enter the Lottery

As a USC, you only need ypur passport to enter the US. DV is just that .. a lottery .. more chance of missing out rather than getting a visa through DV  

Submit the I130 to start the spouse visa process. Unless you registered the children's births through CRBA, you will need I 130 for each of them also. You will have more evidence now of a bonafide marriage. You can apply from anywhere as USC.. your spouse must interview in a country where he has legal residency or in his country of citizenship.  You must demonstrate that  you will be residing in the US, so you need to be prepared to return ahead of his interview as part of the evidence of this. You likely need a joint sponsor to meet the financial

support requirements. The I130 will take 12 months to be approved.. only after that will you need to deal with domicile back into the US and the sponsorship issues .

Why not just petition him for a spouse visa?   Yes it will take several years, but it’s a ‘sure thing’ vs the DV lottery.

It is not clear to me, are you planning on relocating back to the US?  You mention getting a green card, then talk about visitor visas and living abroad.  If the plan is to relocate, file the I130 for a spousal visa, I assume the children are already USCs.

what plans do u foresee for what happens after January?   i mean does he have to return to Morocco when he graduates?

If so,  before he leaves whatever country u are now in,  get a police clearance for the future spouse visa petition

 

Have u gone thru the process to get US citizenship for your kids?

 Have u been filing US tax returns as i assume you were supporting him while he was in college?

 

Apply for the Spouse visa $535/  also the dv lottery as its free and doesn't hurt to try
