Next Steps after AOS from B2 Approval (Married to U.S. Citizen)

Hi everyone!

 

Finally I received notification that my AOS package (i130 & i-1485) is approved after a year!

 

The expected timeframe is for the green card to arrive within 90 days.

 

It's been a long time since I was in this forum (not since the pandemic!).

 

What are my next steps for U.S. citizenship? Do I need to apply to have conditions removed or is that only for AOS from K1?

 

Note: My AOS is from B2 tourist visa.

 

I was looking for a guide in the forums but couldn't find any.

 

Appreciate any comments. Thank you!

No, it isn't just for AOS from K-1.

You could start by filling in your timeline.  Are you getting a 2-year GC or a 10-year GC? In other words, how long have you been married as of the day your Adjustment was approved?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You must have been married to the US citizen for 3 years AND you must have been a Green Card holder for 3 years to file for citizenship. 

The requirement for Removal of Conditions depends on how long you were married as of the day your AOS was approved.

It's going to be a 2 year GC.

 

It looks like I'll have to file the I-751 to remove conditions 90 days before expiration of my 2 year GC, and have it renewed for a 10 year GC. Is that correct?

 

In 2025, I will have 3 years of marriage and 3 years as a green card holder. Can I then apply for U.S. citizenship?

Yes and Yes!!!  You can file for citizenship with a pending I-751
