I-485 Wait times & Info

Just some information to pass along. Checking today with USCIS if you're waiting for an AOS interview in Atlanta like we are, the wait times are averaging 27.5 months for 80% of the cases, and so far we have been waiting 15 months. My wife was issued an EAD card in NOV 2021 to permit her to work, but its only good for 2yrs. If you need to renew it you must fill out a form I-765, but you cannot submit it more then 180 days out from your EAD work card expiring. Last, if you're married for at least 3yrs and want to apply for Citizenship you cannot skip the AOS process since you must have a Resident card (Green Card) to apply for Citizenship. If I may add: You cannot apply for citizenship until 3 years after Adjustment of Status is approved.   You must have had a Green Card for 3 years before applying. 

 

Both of these must be true:

1.  Married to US citizen for 3 years.

2.  Green Card holder for 3 years.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Adding to this:

Never stop building and collecting evidence.

If you have been married less than two years at the time of GC approval, you will receive a conditional green card. 90 days prior to the expiration of that green card, you have to file for removal of conditions, which will grant you a 10 year gc upon approva. If your ROC is pending by the time your green card is three years old, and you've been married to the same USC for three years, you can apply for N400.

 

If you're divorced, you need to wait  5 years before applying for citizenship.

FROM F1 TO AOS

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!
