Moving to USA with my husband & 3 kids all Uk citizens only

Hello 

 

hoping someone can help!

 

we’re looking to relocate to the east coast and I’m struggling to know exactly what forms I need to do! 
 

situation;

 

- I have dual Uk & USA

- husband and 3 kids all UK citizens only (my kids are not eligible for USA passports due to not meeting the physical presence requirement) 

- I do not work, my husband is the bread winner, ideally he secures a role in the USA prior to moving 

- we intend to pay for the children to go down the private school system 

- husband and I have been married for 8 years 

 

We’re open to a few areas and it will really depend on the job first, is there any way he can start applying for roles whilst waiting for approvals? Is there any fast track option to start working whilst waiting?

Since you’re not working and relocating for a job dcf option is not available. File 4 I-130s. You can do it online.

u need to check on work possibilities in the area u intend to move to

Just had a look at DCF, not sure we’d qualify….
 

The issue I see is, in order for my husband to show his income is adequate, he has to keep the same source of income after green card… 

so that means any job would have to be done remotely from the UK whilst we’re waiting for visas? Obviously this would narrow his search down.


are there any other financial tests they can do - assets etc?

Read the I 864 to see what the requirements are, despite what it says income seems much more important.

He will have trouble getting a foot in the door of any US employer until he has work authorization .. that will only happen when he enters the US with his immigrant visa 

 

Simplest answer is to get one or more joint sponsors .. a joint sponsor does not need to sponsor all immigrants .. if you have a couple of US based family members who are open to this, they could each sponsor 2 of the family members 

 

Assets are possible .. the amount needs to be 3-5 x the required income and must be able to be liquidated within 12 months.. depends what savings, funds etc you have .. and the exchange rate 😬

If your husband's employer is able to move him from UK to the US you might be able to go the DCF route. 

London is quite amenable to DCF for a variety of reasons...

The poster I'm linking to DCF'ed after the USC applied for a part-time job then used the beneficiary's income for the I-864...

If you can find a job in the US while still living in the UK you can use that for DCF reasons and then if your husband can transfer with his current company you can use that for the I-864... 

If this not possible you will have to file separate I-130s for all your family members and then either qualify with assets or find a joint sponsor for the NVC stage. 

At the interview the CO will make the final decision...

I’ve emailed the London embassy to see if this is a request that can be expedited.

 

quick q, if I’m not lucky with face to face apppointment, I need to fill in the i-130 for all my family, am I right in thinking that each of my family members need one? 
 

I read somewhere that maybe my children may not been a visa if we plan to pay for private schooling - is this correct or did I get the wrong end of the stick?
