Got my RFE in the mail today and reads: Need intial evidence that I have met my fiancee in person in the past 2 years. Include pictures, boarding passes, passport stamps or military papers.....I did send pictures as evidence so why this RFE?

I no longer have my boarding passes or ticket reciepts, but I can obtain a copy of my frequent flyer statments that indicate flights numbers, dates of travel with my name and account number...Would this be OK? My passport does not have any stamps because Cuba does not stamp US passports, so what else can I use for evidence of meeting? E-mails, phone records, disc or tapes are not considered evidence for them...PLEASE HELP!

Pictures are only secondary evidence. They will not stand alone. Passport stamps prove you've been there. You can't get that, so the next best thing would be boarding passes. You neglected to save those, so the next best thing would be evidence you paid for a hotel room or used an ATM or paid a restaurant tab with a credit card or even with cash if you have a dated receipt.

Think about what proof might exist that you were in Cuba within the past two years and get your hands on it.

Call the airlines as well, sometimes they can pull records that a boarding pass was issued, with dates, times, seat. They have to keep records, I just dont know for how long. Also, I beg to differ about emails and chat logs. Find ones right before the trip where the two of u may have discussed details of travel. Find some from AFTER the trip when u come home soo excited and share things you did or missed about each other. But try the airlines OR where you got the tickets from. I get mine from cheapseats.com and I can log in and see all my itineraries and print them out. Check with your travel agent or online where u got them. How did you make and pay for your hotel reservation? Was it just for you? or for you AND him?

We can argue about emails as proof until we're blue in the face but USCIS says they aren't proof. Would you argue with God? On the other hand, even though hotel reservations don't prove anything a receipt from a hotel in country bearing the petitioner's name is enough. It need not bear the beneficiary's name. Proving you were in the same country at the same time is sufficient. Proving you planned a trip doesn't prove you made the trip. You might get buy proving you bought tickets but they really want proof you used them.

Ischia,

You've got your work cut out for you and a very steep road ahead. Collect any and every document which illustrates that you were in Cuba during the time you declared.

If you cannot provide a Cuban visa, admission stamps in your passport, or military orders verifying that you were in Cuba during the time you claim, then you have no primary evidence to submit. According to the RFE, secondary evidence is useful when it supports the primary evidence submitted. Based on what you've written, USCIS may have ample reason to decline the petition.

You might consider speaking with an attorney who has experience with Cuban immigration. Florida is a good place to start the search. Be prepared for many hours of work, research, talking to people, and spending some money. Get a realistic perspective about your situation, and what needs to be done. USCIS has given you a couple of months to respond. Get to work, kid.

RFE, May 2007

The petitioner and the beneficiary must have met in person between - insert date - and - insert date -. Submit evidence of meeting the beneficiary in person within the two-year period preceding the filing of the petition. The primary evidence may include copies of passport pages that show the identification page and admission stamps, military order(s), letter from Commanding Officer, or any evidence that will help the Service to determine that the petitioner has met the beneficiary with the two years.

The secondary evidence may be airline ticket stubs and receipts (that indicate month, day, and year), ATM and credit card transactions, flight itinerary on airline/travel agency letterhead, etc. NOTE: Secondary evidence is used to support any primary evidence that has been submitted. The following DOES NOT constitute evidence of meeting: disc, videos, emails, letters, phone bills, and greeting cards.

Petitioner may also submit bank statements and/or credit card statements and receipts showing that a withdrawal/purchase was made in - insert country -. Please ensure that any documentation that is submitted has the petitioner's name, location, and the full date (month, day, and year).

Is it possible for a couple to meet in a different country? That would seem to be the most logical way of going about doing it if you can. You can not show any evidence you entered Cuba if you are a US citizen as you are not allowed to.

I can furnish frequent flyer statements that have dates including year and destination, would this work? what else can I send???

send anything you can think of...you must have used a credit card at some point, to book the flight, to withdraw from an atm while you were there...to charge things while you were there...send the frequent flyer miles and get reciepts from the airline companies...it could take a while, but give them enough hassle and they will give you itineraries and/or copies of the tickets

good luck...send it all!!!
