Hello,

Using this platform to see if anyone is or has been in the same boat.

My spouse was sponsored for an EB3 VISA. after a year of waiting for an interview, it happened in Montreal this past August 22nd. I wasn’t able to provide my medical as my doctor has postponed my appointment because of covid. We attended the interview, my spouse received an approval right away, and I was refused and presented with a 221g refusal letter,  due to lack of medical. That is understandable. The medical was submitted to them electronically two days after the interview (Aug 24th). So far no news and they have my passport.

As per their page, there was an update made on the file the 16th of Sept (8 business days ago). But nothing yet. I am wondering if I should get concerned?

Anyone has been through something similar?

thank you,

J

No, its not. I am waiting for interview and we have very small population of eb3 in this forum for eb3 so asked the dq date!! Is your spouse healthcare worker by any chance!!

People in the group below might help you with your question!!

@SteveInBoston Hi Steve, Thank you for the suggestion... I did email them and received a very generic reply syaing "Acknowledge receipt of your medical. If anything else is required we will contact you". And that is ok, I am just wondering if they are just much busier than usual with and I am looking at another month or so. I need to travel soon and would prefer not to reach out to get my passport termporarily to yet delay the processing even further.

Hey!

I'm in a slightly different situation, but also waiting on administrative processing at the MTL embassy right now (did my CR1 visa interview on Aug 3rd and had to resubmit my rcmp background check that was wrong the first time. UGH.).

From what I gathered from my interviewing officer, this site, and my lawyer is that it can be anywhere from 4-8 weeks to have them process whatever we send in, no matter what it is. 6 weeks is an often quoted time. So, it sounds like you're still in typical wait time range unfortunately. But it's encouraging to see movement on your file on the 16th, hopefully it comes soon for you!

I also needed to travel abroad while I've been waiting and didn't want to ask for my passport back. So, I got a temporary duplicate passport as explained in this post:

It was a surprisingly easy and quick process for me at the downtown Toronto passport office. Might be worth it if you have the money to throw at the problem. (I will note, mine temp passport doesn't have a white cover like in the photo!)

Good luck - I hope you make your travel plans and clear this whole messy process soon!

Can I ask what rcmp certificate you had that was wrong? And which was right?

IR1 / IR2

June 2022 IR1 - DQ

Aug 2022 IR2 - DQ

Oct 2022 - Interview

Yeah, so I requested a criminal record check for personal use (formerly privacy act request), but there are 3 subtypes and I received the wrong version.

The correct one to request is "other (provide details)" and then you need to specify "RCMP National Repository entire holdings” in the comments section when requesting.  It will say "other (provide details)" on the form you receive.

The one I originally received that was wrong is the other subtype: "for active criminal record". If you don't specify which subtype in the request then the rcmp seems to revert to this option. In my case the NVC approved this form even though it was wrong, which I only found out at the interview.

Here's a good post with more detailed explanation and examples:

Montreal is really slow. I wouldn’t start worrying until you pass the 3 month mark.

Thank you for your reply. It is certainly good to know I could apply for a temp passport... I was a bit worried as I assumed once medical test was submitted they would make a decision within days, considering my spouse received the visa just a couple of days after.

Thanks again and all the best with your process as well

Hey! I am in in a similar boat and was looking into getting an inaccessible passport. What is the process? I cant seem to find the application forms online. Did you just walk into the passport office? How long did the process take and can I go into the US with this passport?

@Lookingforhelp05 - check out the link that I included above to ToddD's post about this. He put a lot of effort into writing out the process, so there's no point in me repeating it. I will add that I filled out this form AND the regular passport renewal form.

It took me under 2 hours to apply at the passport office on Victoria St in Toronto. 5 minutes to pick it up the next day. I successfully traveled to the US on the new temporary passport, but was taken in for secondary questioning at Pearson before being allowed to cross. Be prepared to speak about why you have a brand new passport, why you're going to the US, and when you're returning to Canada. I was going to a family wedding and had to show the invitation and my return flight. Since then, I've also traveled to Europe on this passport with no issues.

Hope that helps!
