Rental agreement co-signatory?

Hi all,

Not sure what others experience is of this - my Fiance is currently apartment hunting in advance of my arrival next week, we have found a place and are filling out the lease application, obviously I have left my UK job and do not have one lined up in the US as yet as I won't be able to work until I get EAD etc etc.

Can I still apply to have my name on the lease or can it only be in his name? I am afraid of how it will look when adjusting status if I'm not on it but then again I'm not sure how I can be on it with no employer reference or US credit history as yet as the form is designed as if you are an employed US citizen! I can provide my last 3 payslips and bank statements etc but not sure how this is relevant given that I no longer work there and am relocating...

Any advice on the topic will be appreciated!

hmm, well if you can't apply to put your name on the lease, you could always open up a joint account together.

It really doesn't matter if your name's on the lease or not right now... we didn't even HAVE a lease when I adjusted status because they (the complex management) said we didn't need one. We only just got me put on our lease this year, so that we have it for lifting conditions.

For AOS, it may not matter, but the USC needs to check with apartment policies and state laws to make sure it's "okay" for the immigrant to not be on the lease - where I lived once, I was not on the lease but we could have gotten kicked out for not adding my name to the lease. Where we are moving to, they require that names of all occupants be on the lease, or we could be evicted for breaking the lease.

I guess it depends on the apartment complex. I waited until after we got married and was added onto my husbands bank account until I summoned up the courage to submit my application for being added onto the lease. They were really nice, they knew that my credit check would be declined as I was so new to the country, so they didnt do one!! They checked my criminal background which came back all good so they were happy to add me as a co-signatory. All I needed to do was submit a copy of my DL and Social Security Card. I also advised them that I was a student (I'll be starting community college full time in the fall) and I think they liked the sound of that rather than unemployed!
