US citizen married + living in UK with spouse for 5+ years. Unsure which method is best for us being able to move to the US?

Apply as soon as she is eligible.   If she has already been accepted into the MBA program then she can contact London.   This is the easiest and cheapest way to do a spousal - assuming the consulate agrees.

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Sorry if I come across as silly, I am on the spectrum and need complete clarity otherwise I'll be uncertain that I am understanding correctly. A lot of my browsing tells me that the i-130 is always the thing to do straight away which is why I am getting a little confused.

But for final clarity, we should:

1. DO NOTHING (not even the i-130 form)

2. Wait till we hear from her MBA

3. If accepted, contact London (I assume you mean the US embassy?) and apply for DCF citing the employer sponsored MBA
4. Wait to hear back before doing anything else? Or do we then submit the i-130 ?


And if she isn't accepted, she will be getting an office transfer to the US, so the above would still apply, only instead of MBA it is for the job itself?

If you file the petition by mail to the USA, then DCF is out of the question.

Wait until acceptance to the MBA program and letter from your employer that indicates it's part of your job, the ask permission to file the I-130 in London by DCF.

 

If the MBA program falls through, and you still have a job transfer, once you have that documented, follow permission then file model above.

Send the DCF request to the Immigrant Visa unit at the US embassy in London using this form -- https://uk.usembassy.gov/visas/iv-contact_form/

 

Wait for the reply, which will say either they accept, or they refuse, or they need additional information from you.  If they accept, they will send instructions on submitting the I-130 in person at the embassy.
