That would be category C06 and you still need an actual EAD document to work. Yes, she is eligible to work for the first 90 days but she won’t be getting an EAD that fast. It currently takes 8.5-12 months. In the good old days they used to give stamps at the POE for K1 and they could work for 90 days, alternatively they could apply for EAD under C06 and receive an EAD very fast because processing times were much less than they are now. Hence why that category is pretty much obsolete as stated by @K1visaHopeful

A06 not C06.

But read the language I attached it says authorization and/or EAD

If you don’t believe the people here (which is foolhardy as they are giving you good advice - but hey, it’s your right), I’d suggest you take a look at form I-9 (which every employer must complete before they hire anybody) and consider how your wife would be able to satisfy the requirements.

Sorry that you got your hopes up but this time will pass eventually. She’ll just have to wait her turn.

An immigration attorney told me the K-1 visa gives you the right to work for 90 days.  This notice of action says if your EAD request is under an eligible category for automatic extension listed on USCIS.gov/EAD auto extend, then it is automatically extended if you file within the correct timeframe.  The C09 is listed as an automatic extension

Simply put, that attorney is wrong if he/she said you can work without receiving a valid EAD.  An I-797 is NOT an EAD. You might be surprised at how much inaccurate attorney advice we see here.  Below is accurate attorney info:

Getting a Work Permit While on a K-1 Fiancé Visa | Nolo

"The difficulty with applying for a work permit is that the USCIS Service Centers routinely take at least three months to issue them, and often longer. This means that your chances of receiving your work permit while you are still eligible for it, as the holder of a fiancé visa, are slim to nonexistent."

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Obviously I paid an immigration attorney for bad information, fortunately I reached out on this platform before I began paying my new wife through one of my companies.  I wanted to be 100% sure what she told me was true.  I was having a hard time believing you could work after arriving, then not work while waiting for the EAD, then work again.  She is anxious to keep busy, we will just have to be creative for the next few months, while waiting for the EAD

Thanks all
