Timeline

When your case is approved it can take two weeks or longer for the actual file to be sent to Islamabad. Your approval was right at one week ago and yesterday was a holiday so it may not have been sent as of yet. Sometimes the diplomatic pouches are sent in batches.

When you get your approval the case is first sent electronically and is received immediately. It will not show completely in the system until the diplomatic pouch arrives by courier and is matched to the electronic file. Give it a little while longer.

I am sort of new here, and in answer to your question, it is hard to say if it influences the embassy positively or not if you go to the interview. I went to my husband's interview in Islamabad and the lady behind the glass told me to go sit down , that I was not allowed to stand with him at the window. That was after I had been told by another worker that it was ok for me to be present. I will say, even though we were one of the first ones in, we were the last to be called, don't know why. But for his sake I am glad I was there, as he was very nervous. If I had to do it over, I would go again.

Thanks for replying Pluan , So what is ur case status now like u said u were with ur husband for his interview is he in AP now for how long then?Yeah evryone is saying even if i go with him for his interview wont b any good .Since i have no say at that time .So im re thinking what to do .

I have been rereading Mrs. Saiff's posts

2. You filed for a K-1 and then got married within 6 months. I highlighted this in the bold red.

If you married before the K-1 was approved and adjudicated then you are not eligible for a fiance visa. This appears to be your problem all together that you did not meet the criteria for a K-1. This visa should be cancelled and not in AP. When he interviewed did he tell them that he was married? If so they should of told him a visa was not available to him on K-1 and that you would need to file an I-130 stand alone or with another I-129F for a K-3.

It was I-129 now its K3

3. You really need to call DOS and see what the status of the original visa is with them.

There answer is alway same its under Admintsrative process which is AP4. You are able to attend the interview like plaun stated but may not be able to speak.

True5. Which visa route are you going this time? K-3 or IR-1 since you have been married over 2years (2005-08-14).

K-36. Your husband may get AP but that is because more than likely he never was in AP since you were ineligible for the K-1.

He was in Ap they clearly said it under admistrative process .

Because if you were an LPR you would be waiting on a visa number. Being a citizen gives you the advantage of not having to wait your husband will be able to get his visa immediately. :yes:

I am confused as to why they are saying AP yet since they should of cancelled the K-1 when they realized that he was married. Did Islamabad ask marital status at interview? I truly believe that the reason the case is stuck this long is because of the marriage taking place.

Good luck on his upcoming interview.

the Q is did they inform them of the status change?

Did they declare their marriage to the CO?

did they get married 6mons AFTER the interview while waiting for the AP

or they did they get married in bwt the process that is b4 the interview? well despite when u both got married K-1 is voided. they should've declared their marriage @ that point and filed for marriage visa 3/4 yrs ago (that is whenever marriage took place)

info given is a big vague ... seems to me we r missin' some pieces!

My name is MRs-Saiff not mrs Shariff .And that case is cancelled anyways so i rather not get more questions bout it since im already frusterated n this isnt helping much by questioning is last thing v want v want solutions.Thanks for ur effort in questioning

I think she did the k-1 at first and her fiance was put on a/P , while the wait was too long she went back to pakistan and got married during the AP unknowing her k-1 would not be valid any longer.

She finally learned she would have to file for spouse visa since they were now married, which she did. Time she did this is unknown?

Mrs Saiff, if you would please fill out your timeline from the day you filed your spouse visa we would all be able to help answer you questions. We understand you want help and everybody here is willing to help you, but we need to know more information in order to help you. Has he had his interview again under the spouse visa? if so, tell us the when. Also as Mary was asking , did you formally cancel the K-1 visa by writing a letter with the USCIS before you filed for the spouse visa?

Here is an important point to think which is that what would be the new president Obama's policies regarding immigrations?

And what would be the effect of new administration on visa cases?

If there is anyone who can have answers or have any ideas it would be much helpfull for everyone.

we r askin' these Qs cuz it will impact your present case, nothing else dear ! there is no other reason behind it .. there is a high chance that they will Q you both regarding your past K-1 .. well whatever thta mayb we know that u r suffering and we r in the same boat=) may Allah make this easy upon u and all of us suffering in this unpredictable mysterious AP
