I hate to say it but you are incorrect on the point that a K-3 beneficiary needs an approved I-130 to obtain a K-3 or enter the US. This is a quote from USCIS interpretation of the LIFE Act which governs K-3.

LIFE section 1103(a) adds a classification for the spouse of a U.S.

citizen at section 101(a)(15)(K)(ii) of the Act. The new section

101(a)(15)(K)(ii) of the Act has three requirements for an alien to

obtain this nonimmigrant classification. First, the alien must already

be married to a U.S. citizen who has filed a relative visa petition on

his or her behalf with the Service for purposes of an immigrant visa.

Second, that same U.S. citizen spouse must be petitioning on that

alien's behalf to obtain a nonimmigrant visa. Third, the alien must be seeking to enter

the United States to wait the ``availability of an immigrant visa.''

Section 1103(a) also classifies the children of (K)(ii) aliens under

section 101(a)(15)(K)(iii) of the Act.

A K-3 beneficiary needs an approved I-130 to obtain adjustment of status. A K-3 beneficiary does not need an approved I-130 to obtain the K-3 visa, use the K-3 visa to enter the US, or obtain an employment authorization document.

I have said you do need I-130 to AOS. I quoted as that. but, ISL wont grant K-3. unless you are approvable! the fluke is you have to still go all the security checks. about time its done the I-130 reaches approval and in some cases Cr1 is at the embassy. k-3 was designed to allow you to be reunited yes. that is true. most of the k-3 at ISL dont see the light of day.

try explaining this to people waiting on K-3 for many many months. I for one been waiting for K-3 over a year now. so its not doing what it according to family life act is saying. ;)

its always been the biggest fluke that K-3 is a option- ISL rarely let anyone exercise. but, agian the fluke is if you are comming from islamic country you dont get that opportunity. if that was the case.. most of us waiting in AR hell would have had at least the k-3 granted.

Dear Shon! Please dont give people wrong information. The purpose of K-3 Visa is to unite people while the I-130 petition is still pending! That is the purpose of the K-3 visa! Why would there be even a K-3 visa if you needed an approved I-130.

There is no such thing as initial approval. NOA1 is receipt notice and NOA2 is Approval notice. If you have an approved I-130 you can go through Cr1/IR1 or if u dont its still pending you can file I-129F and your spouse can come on a K-3 visa and file for AOS when his/her I-130 is approved!

I would appreciate it, if you would spare the readers of this forum with your wrong information as wrong information can delay some one's case for no reason! We all ready are getting ####### from consulates and the INS, so please dont make our lives more miserable!

It is very easy to get a police certificate in Pakistan. Technically police department calls it ‘Character Certificate’. SSP (Senior Superintendent of police office issues it however inquiry comes through applicant’s area police station.

For example if you live in Clifton Karachi then SSP of District south will issue you character certificate however Clifton police station will process inquiry/investigation. Just spend some RS then everything will be done without any problem.

I think you should have to have that paper from embassy to get ‘police certificate’. Well you can try without papers.

hello everyone. i'm still working on sending the affidavit of support papers to my husband for his k-3 interview next month. i have a few questions i hope some of you can answer for me:

1 - what form does the co-sponsor, my brother, need to fill out? is it still the I-134 that we BOTH need to fill out or is it a different form?

2 - i still don't have NOA2 for the I-129F, is there anything i can do because i've already called VSC and they said they will send it, this was over a week ago??!!

3 - i'm still filling out I-864 AOS for the I-130 process, i will need my brother as a co-sponsor, will we BOTH need to fill out an I-1864?

4 - how long do you think it will take for these documents to get to pakistan via USPS? what do you guys use for courier service when you send something over to pakistan?

i hope everyone is doing well and are seeing some progress in their cases.

I agree in total with scy. What is holding up the issuance of K-3 visa's is not the lack of an approved I-130, but the sad fact that regardless of whether K-3 or CR-1, applicants from certain countries are subject to that security check hell. A K-3 visa does not need an approved 1-130 in order to be issued, regardless of country. What it needs is the security clearance. The fact that K-3's aren't seeing the light of day as you put it nor reuniting couples sooner as the Life Act was intended has other underlying factors, nothing to do with approved I-130 being required.

I feel for all of you waiting.....I think its horrible *hugs*

1. I am not sure about which form you need the I-134 or I-864 (I did the CR1 and had to file I-864). Your co sponsor has to file the same form with his information.

2. NOAs and mail coming from the centers take roughly two weeks to come via snail mail.

3. See reply to number one question.

4. DO NOT USE USPS. I mailed things to Ishteaq twice and it was over 45 days arrival time. I use Fedex and it it there within one week to 9 days. I highly recommend using this courrier and you can track the progress of your package online.

5. The new rules states one year. But if you have three I would make copies to be safe since you are going thru Islamabad embassy.

i Got my Birth certificates From Muncipa; Administration Office,

i need Advice As u Did about Police Certificate,

yes The Birthcertificate is in English i go 2

what i need to Know, Do i need these to get Attested From Foriegn Office?(Lahore or Islamabad)

i need these for Embassay here So is It rquired to get testified from Forien office or no need ?

It is always good to have your documents notarize from ministry of foreign affairs. Make sure you have English versions of every single document you will submit (like marriage certificate, birth certificate, job or any other supporting document)

Notarize your documents from your own city (if you are from Lahore then get the notarization from LHR

my wife got a packet today and it said she has an interview on april 28th 2006, :dance::) .

do you think that we will get the k-3 visa the same day??

I need to plan my flight i know i am going to leave the states on the 21st of april inshallah, but when should i book my return flight.

Congratulations on your interview next month. Yes your wife has her interview date and in most cases the ladies get their visa same day or within days if the embassy mails it out to them. Good luck on your interview and see your busy getting ready to go and be with her during this time.
