My I-130 was approved 14th of July, but I heard it takes really long after it is approved.

I only received the NOA2 so far, and my wife in Pakistan has received nothing.

We're waiting for the DS-320(Choice of Attorney Form)

I'd rather go with the I-129F(K3) after it is approved, since I heard it takes less time.

I just want to get my spouse here asap. I am tired of waiting.

We filed for the I-130 in the beginning of April, and we filed for the I-129F in the beginning of June.

I think the exact dates of the notices were April 12th,(for the I-130) and June 5th (for the I-129F, K3).

The I-130 was sent to CA, while the I-129F was sent to Chicago.

I can't wait until the I-129F is approved.

How long does it normally take for the spouse to receive the K3 visa after the I-129F is approved? Hafiz said two months. Is that correct? I heard it was like 3 weeks...

if you already paid the fees for CR1, sounds like you did. this will CANCELL the K-3 visa on ya.

since your I-129f has not been approved yet. might as well ignore it. coz the embassy will.

the bottom line is whatever petition gets to the embassy first will be the one she come on.

since the Cr1 is likely to reach the embassy. the K-3 will fizzle and burn. so keep persuing the

Cr1. even if you hold off on the fees at this point . the embassy already will know its comming.

true. but he said he is waiting for the agent of choice. which tells me he is closer to the petition getting to the embassy and fees are paid. this right there is an indication of the k-3 being a dead issue.

I only paid the $190 fees when I filed the I-130 form.

As for the I-129F, I paid $170 just like everyone else.

Please help me out guys. What would be quicker? The regular I-130 or the K3?

Someone replying to my thread was saying that they are currently giving interview dates of Jan and Feb 07 for the K3. That is a loooooong time.

Is that including interview dates for I-130 as well?

BTW, do I even have the K3 option anymore? Based on what bunny was saying is that the I-129F will now be void.

Hiya there Adil....

Let me give you a summary of events for CR-1/IR-1 or I-130 that you just got approved for:

From USCIS it goes to National Visa Center or NVC where NVC will be assigning a case number for your petition and then you and your wife will be getting DS-3032 (choice of agent form) its waived only if you are using a lawyer. Also, in the same packet you will get a Fee bill for $70 for I-864 (Affidavit of Support form). Then it divides into 2 paths from there. DS-3032 path and I-864 path and they are totally independant from each other.

DS-3032 Path:

After sending NVC the DS-3032 back will generate IV visa fee bill for $380. After sending money order or certified check for IV visa you will then receive you DS-230 to fill out. After sending that back assuming that the review of I-864 is completed your case will be completed and will be send to the islamabad embassy

I-864 path:

after sending a money order or a certified check should trigger the generation of I-864 form. After sending it back and then them reviewing it and then receiving your DS-230 will complete your case to be send to the embasssy.

Now what you should keeep it mind is that it takes time for them each step of the way from them getting the forms and fees to move to the next step. On average it takes anhywhere from 3-6 months to get thru NVC but good thing is that people who went thru this step before you have created a lot of shortcuts that can get you some where from a month to 2 months time savings.

After your case gets to islamabad they will send packet 3.5 to your wife or the beneficiary. She needs to get the medical done and get a police certificate from the local police. In addition she will need to send the original birth certificate, marriage ceritificate, letter saying that you (applicant) have send off your I-864 to NVC and a filled out 2nd DS-230 both part I and II. After you send all this and they review them they give you an interview date.

As far as K-3 or I-129F goes as soon as its approved it gets to NVC where its send to the islamabad embassy. After it gets to the embassy they will send your wife a packet 4 which will have the interview date and a list of documents to bring to the interview. depending on how many months in advance is the embassy scheduling interviews your wife will get an interview date. from what I have seen right now they are giving out interview dates in Jan or feb 07 (someone please correct me if I m wrong since I m not that updated on the interview scheduling for islamabad).....

Seems like I-130 will be faster than the I-129F, huh? You said they are giving interview dates of Jan or Feb.

Is that only for I-129F?

Won't my wife have to sign the DS-3032 form? Are they going to send a copy to both of us, or I have to send it to her after it arrives to me?

They only sent me a NOA2 so far, nothing else. I guess I am in the process of waiting for a case number now.

I-130 (CR1) Form:

  • Received NAO1 on April 14, 2006
  • Approved on July 14, 2006
  • Received DS-3032 & Fee for Affidavit on August 07, 2006
  • Waiting for my wife to receive the DS-3032; Mailed out Affidavit Fee on August 09, 2006
  • Mailed out immigration fee on September 25, 2006
  • Overnighted I-864 Affidavit on October 2, 2006
  • Spouse mailed DS230 part I & copy of biographic page from Pakistan on October 23, 2006 (Pakistan date)
  • DS230 part I & copy of biographic page arrives to the NVC on November 06, 2006
  • Case Completed at NVC on November 30, 2006.
  • CR-1 forwarded December 07, 2007, and arrived at Islamabad Embassy on December 12, 2006.
  • Wife picks up packet for CR-1 on January 10, 2007.

I-129F (K3) Form:

  • NOA1 received on June 08, 2006
  • Stamped and mailed a RFAE notice on November 14, 2006 to Homeland Security. Sent next day but too late for K3...
  • USCIS receives my RFAE on November 21, 2006, and case is now at the Missouri Service Center.
  • I-129F approved on November 28, 2006.
  • I-129F forwarded to Islamabad embassy on December 06, 2006.
  • Packet for K3 sent on January 08, 2007 and INTERVIEW DATE is assigned for January 30, 2007.

what is your prove. i would like some prove that once you pay the fees the k3 is dead. i dont think islamabad knows jack about one or the other. i bet you they dont know until the file arrive at embassy.

All you have to do is hold your forms and send them in slowly one by one, each form i believe does not expire for like 6 months.

of course if you send everything in, you k3 is DOA(dead on arrival) lol help give me cpr

i just spoke to one of my friend. His wife came here on k3. he applied for AOS and got the interview date in 3 months. got greencard in 2 weeks after the interview.

Wow babybunny!!!!!!!!!!!!!! How can you think that if someone is "waiting" on choice of agent form, that makes the case closer to embassy???????????????? I think after NOA2, case is assigned a case# at NVC, then choice of agent form is generated, then I-864, then DS-230. And, like hafiz said, you can hold on to I-864 and DS-230 to see if K3 reaches embassy before I-130.

BTW according to state dept. website, CR1 only rides K3 once it has reached embassy. if it is en route to embassy, it does not cancel CR1. here is link

Adil khan does not have enough info at this time. He thinks that after NOA2, he should be getting DS-230!!!!!!!!!!!!!!! (he mislabeled it as DS-320 and no one corrected him).

Someone please post NVC flowchart here. so adil khan understands how many steps are there before case is sent to embassy.

us1415 I think jan.-Feb. '07 interviews are for CR1 not K3. K3 suppose to get fast interview dates.

You have filed so far for I-130 and K3. I-130 has been approved, ALHAMDULILLAH. Am I right?

Now case# will be assigned to I-130 at NVC. Call 603-334-0700 to see if it has been assigned a case#

then you will recieve DS-3032 (choice of agent) and AOS bill

then you send them back to NVC

then they send you I-864

then you send it back to NVC

then they send you DS-230

then you send it back to NVC

then, given everything is complete, they will send it to embassy.

Now!!!!!!!!!! before all this is done, your K3 INSHA ALLAH will be approved.

It will be assigned a case number and sent to embassy.

so there are chances that K3 will go to embassy before I-130, since you have option to be slow in responding to DS-3032, I-864, and DS-230 to have K3 reach embassy before I-130.

The only question I am asking this time is, "how far is embassy giving K3 dates?" any ideas?

I see at this point you did not pay the fees 390.00 <something. >

since, you have an approved I-130. your I-129f could actully be stalled. because the

I-130 take presidence. :yes: I -129f is ONLY for your wife to come to the USA to wait out

approval of I-130. since you got approval you dont need the k-3. since she has approval you could very well be forced to follow with the I-130 petition. since you got NOA1 the next steps is to get your AOS fee bill and Agent of choice...your other fee bills and packets.

your case is happening like what happend to Mary. the I-130 is moving faster than the I-129f.

what can happen at this point is the petition could reach the embassy and it could be cancelled because

the Cr1 takes presidence. now in my case, we got the interview of I-129f. and a month later got

approval on the I-130. they kept us waiting. once I paid the I-130 fees they processed the case.

they were not gonna issue K-3 visa. :no: ultimately what happen 7 months on AP/AR. they cancelled it on us. :angry: I am a prime example of what could happen.

it dont take long once you send in choice of agent and the fees. everything is fast from that point

it took 2 months or less for my I-130 to get case compleate.

as far as the k-3 there is nothign he needs to send it.. it makes a quick visit to NVC and off to the embassy.

with the K-3 the embassy sent interview date in the packet. I been though the K-3 and Cr1 process already. let me tell you this. when javed interview for k-3 we had the option of him commin on it..

the moment my I-130 got approved little did I know ..but, my I-129f was dead. I am living proof!

you think I did not want javed comming ..I wanted him home right THEN. but, the embassy already knew I had I-130 approval and we spent months on AP/AR til the I-130 reached the embassy. only then did our case move. if you dont belive me talk to mary.

I never said CR1 cancells. K-3 cancelles!!!!!!!!!!!!!!!!!!!! CR1 can convert to Ir1.

I told you our K-3 reached the embassy. we interviewd. little did we know they cancelled it.. :huh:

for 7 months we sat on AP/AR. thinking we will get k-3 visa WRONG we did not. they sent all the

papers to Javed in May. :yes: the K-3 is to allow your spouse to come WAIT for I-130 approval.

its supposd to be a fast visa but, we are all living proof its not. if thats is true all of us would be off AP/AR. rember Psoft is bringing over his desi wife. :huh:

true. but he said he is waiting for the agent of choice. which tells me he is closer to the petition getting to the embassy and fees are paid. this right there is an indication of the k-3 being a dead issue.

Wow babybunny!!!!!!!!!!!!!! How can you think that if someone is "waiting" on choice of agent form, that makes the case closer to embassy???????????????? I think after NOA2, case is assigned a case# at NVC, then choice of agent form is generated, then I-864, then DS-230. And, like hafiz said, you can hold on to I-864 and DS-230 to see if K3 reaches embassy before I-130.

BTW according to state dept. website, CR1 only rides K3 once it has reached embassy. if it is en route to embassy, it does not cancel CR1. here is link

Adil khan does not have enough info at this time. He thinks that after NOA2, he should be getting DS-230!!!!!!!!!!!!!!! (he mislabeled it as DS-320 and no one corrected him).

Someone please post NVC flowchart here. so adil khan understands how many steps are there before case is sent to embassy.

us1415 I think jan.-Feb. '07 interviews are for CR1 not K3. K3 suppose to get fast interview dates.

You have filed so far for I-130 and K3. I-130 has been approved, ALHAMDULILLAH. Am I right?

Now case# will be assigned to I-130 at NVC. Call 603-334-0700 to see if it has been assigned a case#

then you will recieve DS-3032 (choice of agent) and AOS bill

then you send them back to NVC

then they send you I-864

then you send it back to NVC

then they send you DS-230

then you send it back to NVC

then, given everything is complete, they will send it to embassy.

Now!!!!!!!!!! before all this is done, your K3 INSHA ALLAH will be approved.

It will be assigned a case number and sent to embassy.

so there are chances that K3 will go to embassy before I-130, since you have option to be slow in responding to DS-3032, I-864, and DS-230 to have K3 reach embassy before I-130.

The only question I am asking this time is, "how far is embassy giving K3 dates?" any ideas?

  • Received NAO1 on April 14, 2006
  • Approved on July 14, 2006
  • Received DS-3032 & Fee for Affidavit on August 07, 2006
  • Waiting for my wife to receive the DS-3032; Mailed out Affidavit Fee on August 09, 2006
  • Mailed out immigration fee on September 25, 2006
  • Overnighted I-864 Affidavit on October 2, 2006
  • Spouse mailed DS230 part I & copy of biographic page from Pakistan on October 23, 2006 (Pakistan date)
  • DS230 part I & copy of biographic page arrives to the NVC on November 06, 2006
  • Case Completed at NVC on November 30, 2006.
  • CR-1 forwarded December 07, 2007, and arrived at Islamabad Embassy on December 12, 2006.
  • Wife picks up packet for CR-1 on January 10, 2007.

I-129F (K3) Form:

  • NOA1 received on June 08, 2006
  • Stamped and mailed a RFAE notice on November 14, 2006 to Homeland Security. Sent next day but too late for K3...
  • USCIS receives my RFAE on November 21, 2006, and case is now at the Missouri Service Center.
  • I-129F approved on November 28, 2006.
  • I-129F forwarded to Islamabad embassy on December 06, 2006.
  • Packet for K3 sent on January 08, 2007 and INTERVIEW DATE is assigned for January 30, 2007.

to wrap up the discussion I would suggest to keep your hopes with K3 and keep on responding to NVC. If you see that around the time when DS-230 is generated at NVC, K3s are being approved around your timeline, hold that DS-230. If you get K3 approval, tell NVC you will do adjustment of status so I-130 wont reach embassy. If there is no sign of K3 approval, then send DS-230 and wait as long as embassy wants you to. Once you do send it to NVC, it will most likely ride over K3.

But I think above is strategy is worth following since we already paid for K3. And it did work for hafiz. :D

babybunny!!! while I do see your point when you mention cases that had hard time going through this whole process, please also mention cases that didnt have problems. It doesnt hurt to be optimistic. And it relieves some stress to see cases that were easily successful.

I want to go with the K3 and like to avoid the CR-1 somehow.

The only difference in getting an interview date with either CR-1 or K-3 is that with K-3 you will avoid NVC and packet 3.5. Embassy gives them both the same interview date (assuming that the embassy has gotten all the paperwork back and have reviewed them for CR-1)....

If you want to go with K-3 there is no stopping you I have seen people getting their CR-1 at the embassy and getting a K-3 interview....so it should be fine.....as long as your CR-1 doesnt make it to the embassy.....
