It is true that US Embassy issue K/3 visa even if your I130 is pending (my friends took K3 route) and mostly there is no AR for women at least I didn’t hear any yet. So do not worry just pray inshallah things will be workout for you.

Imran... I did not say PENDING. I said approved.

PENDING is diffrent from approval. you can have a I-130 pending

and NOT approved. that NOT approval is not acceptable for getting K-3. you can be APPROVED and while its going throught the process of sitting at NVC. that is called PENDING. you should know that you just got approval. you know your wife could not get k-3 no matter what. til the I-130 approval. so dont say you have friend here on K-3 and dont have approval on I-130. they certainly can have K-3 ONLY with an approved I-130 and await out the Process in the USA.

5. K-1 Visa Holders: Submit Copy of NOA2 "Approval" for I-129F

K-3 Visa Holders: Submit Copy of NOA2 "Approval" for I-130

the bottom line YOU CAN NOT GET A K-3 WITH OUT AN APPROVED I-130 petition. < noa2> it dont take but a few mins to READ the guides that has a link to the USICS home page that will tell you the same thing.

they can NOT approve K-3 visa UNLESS you are approvable. that means having he approved Notice in your hand. this notice YOU must provide when AOS. K-3 you have to AOS.

Dear Shon! Please dont give people wrong information. The purpose of K-3 Visa is to unite people while the I-130 petition is still pending! That is the purpose of the K-3 visa! Why would there be even a K-3 visa if you needed an approved I-130.

There is no such thing as initial approval. NOA1 is receipt notice and NOA2 is Approval notice. If you have an approved I-130 you can go through Cr1/IR1 or if u dont its still pending you can file I-129F and your spouse can come on a K-3 visa and file for AOS when his/her I-130 is approved!

I would appreciate it, if you would spare the readers of this forum with your wrong information as wrong information can delay some one's case for no reason! We all ready are getting ####### from consulates and the INS, so please dont make our lives more miserable!

Thanks Michigan for your feedback as I mentioned yesterday in order to get K/3 Visa it is not required to have I130 approved.

We are talking totally two different things

1, K/3 visa (Embassy issues non-immigrant visa to avoid all CR1 lengthy delay, Once spouse of USC gets K/3 she/he can come and wait until I130 approves)

2. Once I130 approves (while spouse is in US) USC spouse can file AOS of his/her non-immigrant spouse.

you need to READ...

you can NOT enter the USA with out an approved I-130-BOTTOM LINE.

if you are already in the USA. example on student visa or VWP etc..

you get married and AOS . while the I-130 is waiting for approval you can certainly be here.

this is not the case with YOU BOTH. K-3 is designed to allow you to be here and WAIT for the green card.

I wont say CR1. if you are on USA soil it not called CR1.

if you are OUT OF THE USA. the USICS will not ISSUE K-3. until you met I-130 approval. after approval sometimes your I-130 will sit pending for months or longer. this is the IDeal time when you can certainly obtain K-3 visa. but without it they run the risk of you not being approvable.

try asking your attorney in more detailed questions you will get this same response. until you are approvable you wont get NOTHING. if you READ MORE detail in waht YOU are sayng and what RM is saying

then you would REALISE you are getting 1/2 of the story not the full picture.

try asking MORE questins and the RIGHT questions.

NONE of you agee with me I dont care. at this point I have explained more detail to you.

those that came on K-3 ..... I-130 has NOA 2 < approval of I-130 >.

Salaam lay kum,

i dont know what to say,

i called the NVC and they told me that the I-130 needs to be approved. then i asked a lawyer and she said it doesnt have to be approved. now i am really going crazy. :wacko: Mich. puts up that link and i read it and then shon says the opposite. I think what the best thing for me to do is email the embassy and ask if they require the I-130 to have an approval (NOA2) before they can hand over the k-3 visa at the embassy.

when i spoke to the lawyer, she said this is why they have this k-3 route, because sometimes it takes too long for the approval of the I-130 (NOA2) to come.

and when i spoke to the NVC the guy didnt really sound sure, on what he was saying.

shon if you dont mind, i tried looking for that guide but i could not find it, can you post that site where the guide is located.

So i want to know can i get Police Certificate before packet Arrives to me,

What is the Procedure to Get it and From Where? Some Documents needed?

I never Been To police station before So Please tell me Some thing :(:help:

i asked the embassy about the police cert. and they told as soon as you get the packet from the embassy just show the police that packet and tell them that you need a police clearance. they should have no problems with that.

Yes and you will need one from any parts of Pakistan or other countries you lived in since the age of 16 for 6 months or longer. My husband went to school in another city and had to get one from their. Good luck, Atif.

I hate to say it but you are incorrect on the point that a K-3 beneficiary needs an approved I-130 to obtain a K-3 or enter the US. This is a quote from USCIS interpretation of the LIFE Act which governs K-3.

LIFE section 1103(a) adds a classification for the spouse of a U.S.

citizen at section 101(a)(15)(K)(ii) of the Act. The new section

101(a)(15)(K)(ii) of the Act has three requirements for an alien to

obtain this nonimmigrant classification. First, the alien must already

be married to a U.S. citizen who has filed a relative visa petition on

his or her behalf with the Service for purposes of an immigrant visa.

Second, that same U.S. citizen spouse must be petitioning on that

alien's behalf to obtain a nonimmigrant visa. Third, the alien must be seeking to enter

the United States to wait the ``availability of an immigrant visa.''

Section 1103(a) also classifies the children of (K)(ii) aliens under

section 101(a)(15)(K)(iii) of the Act.

A K-3 beneficiary needs an approved I-130 to obtain adjustment of status. A K-3 beneficiary does not need an approved I-130 to obtain the K-3 visa, use the K-3 visa to enter the US, or obtain an employment authorization document.

You can put your inquiry in K/3 folder (I have seen lot of people specially from UK & Canada came to USA on K3). Talk to someone who is already in US via K/3. I told you yesterday my buddies wife came from Pakistan on K/3 their I130 approved after two months of her arrival to US. I can accept that for AOS (Adjustment of Status) one should have NOA2 Of I130.

Embassy will not ask someone by the time of K/3 interview to produce I130 NOA2. Visa consular entitled to ask K/3’s NOA2.

You have already seen SCY comments.
