These are the IR-1 document requirements as listed in the packet 3.5 that Mary had posted a few pages back:

1. Form DS-230 Part 1 and II (All questions on the form must be answered)

2. Birth Certificate (Original and one photocopy)

English Translation of the Birth Certificate (Original and one photocopy)

3. Marriage Certificate (Original and one photocopy)

English Translation of the Marriage Certificate (Original and one photocopy)

4. Death Certificate (Original and one photocopy) if applicable

English Translation of the Death Certificate (Original and one photocopy)

5. Divorce Certificate (Original and one photocopy) if applicable

English Translation of the Divorce Certificate (Original and one photocopy)

6. Applicants who have not submitted an Affidavit of Support with the National Visa Center must submit the following documents:

a. Original, Signed, Form I-864 (Affidavit of Support from the sponsor and notarized by and American notary public or Consular officer at the American Embassy if filing DCF. One I-864 for each derivative applicant and supporting documentation.

b. Complete I-864 with supporting documents from the joint sponsor if needed.

c. Copies of the sponsor’s federal tax returns (Form 1040) for the past (3) years. The newer forms request one year but the embassy asks for all three years.

d. An original job letter and or proof of self- employment from the sponsor.

e. Proof of sponsor’s assets.[/indent][/indent]

7. Photocopy of passport (Valid for 12 months beyond the anticipated visa interview date.)

If you have submitted the I-864 to the NVC stateside just write a cover letter stating that this document was submitted already.

8. Medical Examination Report (Medical examination must be preformed by one of the panel physician’s listed in the booklet)

9. Photographs (Two photographs according to the specifications given in the booklet)

10. (a) Police certificate from your local police jurisdiction.

(cool.gif Police certificate from all countries where you have lived for one year or more since the age of 16 (note this requirement does not apply to residence in the USA or Afghanistan).

Questions ...

What do we need to send the embassy back at this stage? All the documents mentioned above sans medical report (since it says schedule medical as close to interview as possible).

Do we send the original marriage certificate etc. and then they schedule interview?

Also, since we sent DS-230 as well as I-864 to NVC, so I trust we just write a statement of this effect? I am curious though, which situation would require those two forms to be not submitted to NVC.

I submit these documents with packet 3.5 to embassy

1. Nikah Nama original with photo copy

2. Translated in english and photo copy of nika nama

3. DS-230I & II

4. Photo copy of passport

5. 2 pictures

6. Police certificate

7. Original and photo copies of birth certificate

I-864 and tax return for last 3 years were already submitted to NVC. I did not write any statement.

20th July 06------- Receive duplicate DS230 packet

14th September 06-----Case completed and sent US embassy Islamabad

ISLAMABAD EMBASSY

7th November 06----- Embassy upgrade my petition from F2A to IR1.

8th November 06----- Receive packet 3.5 through TCS.

16th November 06---- Embassy receive packet 3.5 and pending for review.

18th January 07----------- Receive Packet 4.

26th March 07------------ Medical Done

29th March 07 ---- INTERVIEW AT 8:00 am

APPROVED ---------- AP Starts

13th July 07 --------- AP END RECEIVE VISA

Is CR-1 requirement different from K-3? I thought the documents they ask are to be brought with you for interview. If you send the originals, do they give it back during the interview?

The letter I posted earlier was from a good friend (not my wife's) and it does not ask to "send" those documents but instead asks to "bring with you" for the interview.

The letter I posted earlier was from a good friend (not my wife's) and it does not ask to "send" those documents but instead asks to "bring with you" for the interview.

CR-1 requirements are you send all in before the interview and take phone records, photos and other ongoing proofs on the day of the interview. The CO will give you back the originals at the time of the interview or will submit them back courrier at a later date in the case of CR-1.

Cr1 is sent a Packet 3.5 and then once they send all the forms in they are scheduled for an interview, With K3 you get the interview date with your packet and you do not submit it in advance.

K3 : Bring all forms and Documents with you at the time of interview

CR1: Send All forms in and then you are scheduled for an interview

I sent an email to embassy if they got our case and they replied third time with the SAME answer, Dear Sir/ Madam we have not received the physical file yet and contact us after TWO weeks.

NVC claim they send it on May 31st.

Hopefully by the end of this week, consulate should have it.

Same here man. I emailed them twice, they only replied back to the last one on monday saying the exact same

thing, we have the electronic file but are waiting on the paper file, contact back after two weeks. And NVC said

they had sent it on the 31st of May. I guess we should keep each other posted.

update... same response today (06-18-07), waiting for physical file, did'nt ask me to wait a couple of weeks to ask them again though. Looks like they are taking their sweet time, while I am stewing, as I have to arrange for time off from work, tickets, yada, yada, can't do a thing till I have a date from them. :unsure:

Khurram, DOS always had updates on late Wednesday afternoons or Thursday morning when I was going thru the processing. Check back with them later in the week.

hello there!

im just sorry that i found this forum so late!

i will appreciate any help!

my husband, a us citizen, went to us in the end of november 2006.

we have been married for 2.5 yrs but decided to move to US now.

on 30 november we got a notice saying that our documents have reached them

and now after 6 months i chked the status online which said

On May 30, 2007, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service.

can anyone tell me what happens after this?

i mean did they send any package, or forms to my husband to fill?

my husband is almost always travelling there, so sometimes his cousin takes care of his paperwork.

but i am kind of worried if he might mess up something

any help will be appreciated!

another thiing now that we have been 'touched' by this notice how long will it take for an interview date

i went to chk the processing dates on https://egov.uscis.gov/cris/jsps/Processtim...eviceCenter=CSC

and they havent listed the timings for I 130 for spouse!

i chked on 18th may and they were processing the cases filed on 13th november 2006 and my case was filed on 30th november 2006

we filed at the california service center

now that i have chked i noticed that of out of all four service centres the only service centre showing the I 130 for spouse or child under 21 (we also filed four our son who just turned 1 (MA) ) is the Nebraska Service centre which is showing that the current cases being processed are the ones filed in September 2006

does that mean that the I 130s for spouse and child under 21 has been transfered to Nebraska Service centre??

if thats what happened then its ROTTEN coz i got pushed three months back!!!!!

After getting same reply twice. I have created a TEMPLATE and sending them SAME Template again and again.lol

I will wait for the email tomorrow and will REPLY back with the same TEMPLATE to ask if they got our case.

The notice that they sent your husband is called NOA2 or "Notice of Approval"

A few weeks after you have received your last Notice of Action indicating the approval and forwarding of your I-130 application to the NVC

The NVC will send your husband a packet of forms that you and your husband must fill out before you can be given an interview date with a consulate abroad.

The packet will likely contain an Of-169 form, and an Of-230 part one and two forms that must be filled out by you.

An I-864 (Affidavit of support) form is also included that must be filled out by your husband.

The I-864 is the Affidavit of Support form that requires copies of your husband's past 3 U.S tax returns (or tax transcripts which are free from the IRS) as well as any bank or financial records available.

Your I-130 is approved so don't worry about the processing times listed, you case is probably at or on its way to the NVC.
