She's hanging in there... I am going to visit PK in December. Hoping that I get some news from USCIS soon. I thought I would bring her with me in December but now that hope has faded away seeing the timeline of people and the fact that I have not even received NOA2.

Hey, same here....I am going for two months in December and was hopeful my husband would come with my daughter and I now that his case is in ISB.....but it looks now that it's not even close. Best of luck.....and hang in there!

Yeah, there's light......but I'm just moving back until it's complete so my husband doesn't miss his daughter's WHOLE life :)

I've been reading all your post and found them interesting and informative and thought i should consult a bit from you about my case status. My wife is US citizen and she filed through attorney for me in US while staying here in Pakistan, since we got married in 2004 dec she is with me and went back once in 2006 Jan and now waiting with me for my case to get approved, my daughter is also US citizen through her. Following is my timeline so far.

29 March 2007 - Applied for I-130 (California Service Center)

30 March 2007 - They received

04 April 2007 - NOA received From

06 or 07 April 2007 - applied for I-129F (Chicago)

09 April 2007 - NOA showed a filed or received day

25 May 2005 - It was transferred to California Service center)

Since then there is no action taken on my case, I've checked the processing time and it went over time frame, but no notification so far.

Can you tell me now whats going to happen and how thing will go like what papers i will be getting and what not? do remember that we have attorney in between so i guess all the papers is what he will be getting not me, if i'm wrong please tell me. do give me a detail step by step with time it takes and when should i expect to get approval & call for interview. One more thing what forms do pack contain which you receive for K3 and how many of pack are we going to get.

Walaikum Salaam,

It took me three moths from the transfer date to my service center to approval but I have heard there is a tremendous backlog right now due to price hike in June and everyone that tried to apply before that. People are even having a problem reveiving their receipts for the forms they submitted (NOA-1).

That being said I hope you approval come soon.

This is whats going to happen:

1. Once case is approved NOA-2 (notice of Approval) will be generated and mailed to you and your lawyer. (sometimes only the lawyer gets the copy but I have seen it both ways).

2. The K3 case is then transfer to the National Visa center and then shipped out to the concerning Embassy and a notification is sent to you and/or your lawyer.

3. Once Embassy receives your case it take approx a week to 10 days to send you the K3 packet which contains the following:

a. Form DS-230 (I)

b. Form DS-156 - 2 copies

c. Parents Form

d. Form DS-157

e. Checklist - Attached

I did not understand your first question, please rephrase it for me

The CIS will stamp your passport with the I-551 stamp if you are approved. This stamp is proof of permanent residency that can be used until you receive your greencard. This normally can take up to six months.

NOTE: Many offices are NOT giving the stamp, even on approved cases; cards are mailed directly to the applicant. Additionally, a tardy namecheck or FBI clearance holds up 'actual' approval. Perment Resdient status does not start until the case is *actually* approved, which may be a later date than the interview. The PR can always look on the face of the card to find out their 'real' date of approval.

While permanent residence normally means the ability to travel freely outside the U.S. and return, there are limitations. Lengthy absences, particularly if they involve work or taking up residence abroad, can lead to abandonment and loss of permanent residence status, or delayed eligibility for naturalization. Absence for a year or more can be particularly problematic.

As a Permanent Resident you have most of the rights of a United States Citizen but there are some exceptions.

Rights

* To live permanently in the United States provided you do not commit any actions that would make you removable (deportable) under the immigration law (section 237, Immigration and Nationality Act).

* To be employed in the United States at any legal work of your qualification and choosing.

* To be protected by all of the laws of the United States, your state of residence and local jurisdictions.

* To vote in local elections where United States Citizenship is not required.

Exceptions

* Some jobs will be limited to United States Citizens because of security concerns.

* You may not vote in elections limited to United States Citizens.

Yes this is new and you have to resubmit the forms. They have been revised since you filled them out the year before. PAIN07 CR-1/IR-1 contacted me a few months back since they were asking for this and told me the forms had been revised. I informed him to resubmit them and it asked for more specific facts and to make sure that he addressed all the questions. Sure enough after some time his visa was ajudicated and I updated the list for the forums. Please do what they ask and inshallah you will have your visa shortly.
