06-11-2007 = NOA1 date (unknown to me).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

My understanding is that getting notice of Prima Facie determination on your VAWA application generally makes you eligible for a state driver's license, financial aid under FAFSA, and health insurance....and possibly other state benefits.

My question is, are your lawyers helping you navigate these processes (all are complicated) or are your state DV counselors helping, or are you doing this on your own?

Thx.

Hello Family, I hope everyone is doing well, just wanted to update, I traveled second time on Travel document this year for a month came back last week, There was no issue at all at the airpot, the officers were nice, just had me sit for few minutes and then stamped the passport.

My VAWA was approved March 2022, Then I-485 moved from Vermont to NBC in September, then in October I recieved a medical deficiency notice on October 5th 2022. My lawyer and I sent the medicals on December 22, 2022.

There is no update on I-485 except it shows that the case was transferred on 16 September for faster processing.

Is there anything I should do?

anyone know how much longer it's going to take?

Should I inquire through congressman next week?

Any insight will really be appreciated. Thank you family.

You shouldn’t push them at this stage. Remember the folks who get RFE for Medicals usually get approved without showing up for interview….You just sent it in December so I believe you should hear something really soon. Just my honest opinion.🙂👍

Thank you, I will wait then. It was RFE but just for the deficiency, they didn't ask  for medicals to be sent in but I was going out of country my lawyer suggested to send in the medicals before I leave.

I hope that won't cause any issue and perhaps help the process.

For i485 they transferred case to somewhere else then applied fingerprints then scheduled the interview. Do the medicals come after interview or before?

Also what is the i485 interview process like? how do i prepare

I think you should have waited for them to send you the RFE for medical. If they sent you the deficiency letter, they would have explain that you wait for either an RFE to submit the medicals or interview. Sending the medical without the RFE letter might delay it or they might even misplace the medicals entirely.

I think there is a part where they advised to bring it in-person unless advised otherwise. I hope it won’t cause any delays. Since this is the case you may enquire through your rep. I actually thought they asked you to send it in as is the situation with some cases. Oh wow! With USCIS it’s best to follow instructions.

I don’t think it’s everyone that’s required to bring in the Medicals. They might not need it if everything looks good on their end. Else they would have requested it. On the other hand they slip up sometimes. For the interview, you can go through your I-485 form and also the I-360 petition one more time just incase they ask questions concerning the case. It’s not supposed to be so but we’ve heard of officers being overzealous. Best be on the safe side. Go with all the original documents pertaining the petition. Be confident, the hard part is done.😊👍
