Thank you but I just checked, it used to say 20 days but now it says, if there is no change to your case within 40 days, please contact your benefit granting agency. 

It's getting further delayed.

You guys, I need thoughts on this. Based on things I've seen here, I thought this was a VAWA approval but now I'm not sure. My understanding is that "the card" is usually a C31 EAD card that is issued with VAWA approval and this is later converted to a C9 card. Because I filed I-485 before I-360, I have just been renewing the C9 card I got with the 485. My most recent C9 EAD came in March 2022 and is good until 2024.

 

What card is this? IF it is the C31, will it invalidate my C9? My I-485 status has not changed since my lawyer requested interview rescheduling. Here's my timeline if it's helpful. It's not very elaborate because I don't recall all the dates but it should give enough of an idea, I think. 

 

August 2019: Filed I-485 as spouse to US citizen. Did not submit medicals. 

Received C9 EAD I think Dec 2019.

Feb 2020: Interview scheduled 

March 2020: Interview rescheduled due to covid

Sept 2020: Interview scheduled 

Sept 2020: Filed I-360, requested interview to be rescheduled and I-485 to be held in abeyance. 

 

Have received multiple prima facies since filing, most recent one was literally two weeks ago. Lawyer is currently on PTO so I won't get an answer until Monday.

 

Any input would be so appreciated! I almost cried with excitement and now I'm not too sure what this means or how it will affect employment.

Congratulations first of all.

This is your C31 card. After that you will get VAWA approval message that might take somewhere 1week to 3 months. Mine took 2 months after the card.

It will not effect your c09 card. I have two cards at this moment. i just posted a question today if you look at the last page of this thread.

On October, 06, 2022, Card was picked up by USPS

On October 3, 2022, we mailed your new card for your form I-765, Application for Employment Authorization 

On September 30, 2022, we approved your form I-765, Application for Employment Authorization 

On September 29, 2022, we ordered your new card for Receipt #_________, and will mail it to the address you gave us

FYI This is the reply I got just now from my congressperson, I guess the case is not stuck in the limbo of background check. Although what does pending processing means?

My C31 EAD is expiring on Feb 2023. However, i have EAD c09 which is expiring on May 2024. what do you think should i renew my C31? if i do not renew will that effect me with anyway? Thanks

 

Don't bother, you just need 1 to be able to keep legally working and C09 is simply the better deal (can be a combo card, issued for 2 years, free renewals).

That's the C31, which yes it means that your I-360 was approved, the approval notice will arrive sometime thereafter. C31 does not invalidated a C9.

I always read horror stories about attorneys sent from hell trying to overcharge their clients for stupid things. It had never happened to me before but today i just spoke to the paralegal who handles my case and everything. My Vawa is 1yr 1 month in and i was checking on the processing for immigration court. She says i got the admin closure but now she’s trying to get the Ice attorney to completely dismiss the case. And she goes on to say that after dismissal, if i want them to file my 485 with USCIS they would charge me $2,500. This is after i have already paid $4,000 for the WHOLE process including AoS. I was so confused and angry because when I consulted with the attorney herself she said it’s $4k for the WHOLE process. WTH!!! 
 

I cannot with these attorneys ripping people off. I definitely told her I’m not paying anymore because they told me the whole process is $4k and i have paid that. And if they want me to pay more i need to talk to the attorney herself. And i expressed my disappointment. All this time I haven’t spoken to the attorney either, only the paralegal. 
 

If they insist i pay more i will file my own 485 by myself and just pay $500 to have the attorney go with me to interview. I’m still so mad about the whole thing.

What's in the contract that you signed?  Verbal assurances mean nothing, when stuff is in writing.

 

I truly believe that some attorneys have kickback agreements with the pharmaceutical companies that manufacture blood-pressure medications.
