From personal experience, If you're a VAWA and one day you wake up and suddenly you encounter this type of status, or say you found out that an important letter, notices from USCIS was returned back by USPS for whatever reasons. Please, don't waste your time talking to Ombudsman, don't waste your time filing e-Request for a copy or writing letter to USCIS or calling or chatting Emma. They all won't help especially if you're VAWA. You'll waste your time especially if it's an interview or RFE or RFI.

Just go straight and write a nicely written letter to your Congressman/woman or Senator and they will help you, esp if it's VAWA.

You'll thank me later.

Happy new year to everyone.

She sent it to Texas because, Vermont stamped an address on top because my receipt number starts with SRC. So in this case , I make another check and copy of original i601 and send it to my local office with a letter explaining that we haven’t received a receipt number from Texas as per uscis vermont direction?

Your suggestion is a good attempt to satisfy RFE and point out the RFE did not contain clear instructions of where to file I-601 nor do online instructions spell out where SRC cases are to file it. ..Field Office won’t cash your new check.

Of course I would have filed it from the get go w Chicago..because they route it to Field Office

Question about the I-131...

If you have a pending 485 and receive Advance Parole (Form I-131), would it be unwise to travel if you have unlawful presence?

I'll try to rephrase:

Unlawfully present. Filed 360, 485, 765, and 131. If granted 131, okay to travel?

Yes it is ok to travel. As long you are not in removal proceedings.

It should be.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Another thing you can do is register an account with USCIS and add this paper filed case to your account. It will show a history overview, so if you see "notice was returned", that'll give you some idea what that notice was.

Contradictions without citations only make you look dumb.

Travelling on Advance Parole (AP) with VAWA and a 485 pending, still requires a humanitarian reason, correct? Like a letter from an ill family member?

You got advance parole. This means you CAN travel without abandoning your AOS, AFAIK. However, AP doesn't guarantee the entry back to the US. Travel at your own risk, and only if it's extremely important and outweighs losing ability to enter the US.

LPRs and US citizens are always admitted into the US, on the other hand.

No, AP from pending I-485 doesn't require a justification. The only reason why it may say that is because the law says that, but in practice if you have a pending I-485 and are not in removal proceedings they will just rubber stamp it.

yes it should be. I traveled to Canada via car. There was no issue.

Thanks @balo101 I also did not face any issue and was able to get back fine.

Going to mexico via santa teresa port

We have to go to the building to process the immigration paperwork. I have to get mexican tourist visa given to me for 6 months and costed $58 usd. I also have to register my vehicle which also costed me $51 USD.

Coming back to USA via santa teresa port

I was flagged for inspection and have to take my car through xray machine and they also check the engine area and trunk and then I have to go to the building so officer can process my parole. Since it was holiday season, the cbp officer said that they are short staffed and will take 4 to 5 hours to process me and have an option to go to el paso port of entry and I said i will wait. They had two case before me and as per them I think two people did something illegal and got caught and I think they brought some drugs. While processing my parole the officer said " you know that it's officer discretion if they should let you in or not and I suggest not to travel with advance parole. When you get your green card then you don't have to see me and can just cross the border" Then I realized that crossing border via land is more pain then via air. They also charge me $6 and gave me a paper i-94. This whole process took 3.5 hours which is very long.

It would go to Vermont. You just need EAD application/AP application if you need that, copy of current EAD and 2 passport size pictures, 4 pics if you are renewing AP as well.
