Timeline

Help: My daughter and I submitted 360 at the same time in 2018. My 360 approval date was December 3, 2019, and my daughter’s 360 approval date was December 15, 2019, 12 days later than me. There was a problem when we submitted the 485: my daughter’s 485 approval date was April 20, 2023, and my 485 approval date was May 7, 2023. My daughter was approved before me. A lawyer said that my daughter's green card is invalid because she must wait for my green card to be approved before her green card is legal. The lawyer suggested that I return my daughter's green card to the immigration office, otherwise she will not be able to naturalize in the future. Does anyone know anything about this situation? Please guide me what should I do? Thanks 🙏

What about resident since dates on your GC vs daughter's?

There is only one path as outlined. A great deal of what your attorney emailed is pure bs . ..but “sounds “reasonable 

You can resolve things with your attorney ( without conflict) by showing them you now understand the process AND insist filing the motion ( terminate/recalender) w court is the next immediate step you want them to take. If they agree , you are all set
Ask for a copy of the motion .

Attorney is wrong and making you worry needlessly.

Each of you submitted a stand-alone I-360 …so the sequence of I-485 does not matter.

Your daughter does not need to return her card. Advice you received is very wrong and very skewed…ho

She was a principal in her own I-360 , not a derivative of yours. Does nor matter same abuser .

I am saying that because she had her own I-360 the date on her green card IS NOT tied to/ dependent on yours…so no matter if before your date.

She will have no problem naturalizing . 
You did a good job by filing a separate I-360 for her..as it guaranteed her process independent of yours.

I called 70 lawyers in 2 months so I can fire my unmotivated lawyer at that time. Almost pulled the trigger to hire a new lawyer but in the meantime once a week I keep sending email to my current lawyer. He can’t stand it after 8-9 months ghosting me finally he gave up because of my persistent and filed termination to the court.

 

always have ur eggs in many basket. @Family know I even wrote motion to terminate in 4 versions just in case everything didn’t go through

Which was nebraska . They rejected cuz of no active hearing I believe so . I don’t know if I’m going to get approved it will be really luck .
