Hello Family, I hope everyone is doing great.

I had vaca approved May 2022, I-485 interview on May 17 2023, they issued rfe and I ssubmitted it and they recieved it May 31st 2023,

there is still no update online except that the rfe was issued, so I went to local office, they guy confirmed , that they did receive the required medical and they interviewing officers has it in her file, but I don't know why they are still working on it and hadn't made any decision, it's been over three months. I couldn't talk to the lady. 

he said just wait because they are working on case by case basis. any idea why the delay and how much longer I might have to wait?

I agree what demise said. If your VAWA is approved then you can terminate your asylum. Hire a good attorney. USCIS will not make any decision until you are out of court. Do not delay.

It should be straight forward from this point. Those people just sitting on our files for nothing. 

After the interview if they just ask you for the medical then i do not see any reason for delay except they are just lazy.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

It is Wednesday, and it's time for our highly effective, always-hilarious Semiofficial Semiweekly VAWA-Thread Joke:

THE HILLBILLY MANEUVER

 

Two hillbillies walked into a restaurant.  While having a bite to eat, they talked about their moonshine operation.

 

Suddenly, a woman who was eating a sandwich at a nearby table began to cough.  After a minute or so, it became apparent that she was in real distress.

 

One of the hillbillies looked at her and said, "Kin ya swallow?"

 

The woman shook her head "no."

 

The hillbilly asked, "Kin ya breathe?"

 

The woman, now turning blue, shook her head "no."

 

The hillbilly walked over to the woman, lifted up her dress, yanked down her drawers, and quickly gave her right butt-cheek a lick with his tongue.  The woman was so shocked that she had a violent spasm, and the obstruction flew out of her mouth.

 

As she began to breathe again, the Hillbilly slowly walked back to his table.  His partner said, "Ya know, I'd heerd of that there 'Hind-Lick Maneuver,' but I ain't never seen nobody do it!"

Get those proceedings terminated, USCIS technically doesn't have jurisdiction over the I-485 while you're in removal proceedings. Best that you could get from them right now is USCIS admin closing the I-485 until you get a termination or until you file with the court instead.

 

Anyways - the way that it works for missing medicals is this:

If USCIS chooses to waive the interview they will RFE you for it.

If USCIS chooses to interview you, you bring the medical with you to the interview.

 

 

Anyways, while we're here, has anyone gotten an interview waived after an EWI?

But my attorney told me when we will get approval notice for I- 485 then we will ask to terminate to my removal proceeding.  She submitted to uscis instead of court because they’re so fast what they told me .  My removal actually administratively closed . I was think I can also terminate with Vawa approval notice but they didn’t try that way. It’s so confusing me I am simple waiting .

I always heard it's done the other way round as @Demise described. Have you consulted with any other attorney? Does your attorney have a lot of experience dealing with cases like yours? Are they real attorney?

Nope I have not consulted with any other attorneys yet .  I know they have some Vawa case also this attorney is immigration lawyer and has some more attorney in her law group.I don’t know what she has in her mind I always need to correct them to be honest . I found they sent expired form , I found Vawa missing documents which I sent and I got approved right away after little while  but I paid I don’t want any other cost adding on my file . Problem is practicing assistants are unknown :) at least 6 attorneys in this law group and all of them immigration attorneys if they still making mistake really shame on them .

You will be lucky if USCIS approves your form i-485. As olduser said, talk to an other attorney. USCIS will also admin close your i-485 if your asylum case not terminated.

I have no asylum case , I have removal from not showing up at the interview because marriage was already under threatening situations so I decided to go with Vawa instead of going to interview with danger person. Then I gathered all documents and submitted as we called it Vawa then while Vawa pending I went a time court and judge administratively closed my removal case  and wait Vawa approve . I got Vawa approved  but now I’m waiting I-485 approve this makes me confused .

basically that's what i meant to get out of court by terminating removal. Just consult with another attorney just to get an idea to see if your attorney is doing right thing. You do not want to get involved unnecessary wait time.
