He should send the form to  Vermont, if he filed the vawa/AOS with them, but if he got a letter about transferring the case then he has to submit to the place that Uscis transferred  the case .

VAWA approved recently, planning to travel abroad, might can expect fingerprints again, or Medical RFE or even interview request along with Medical. What to do when he will be out of states? Anyone been through same before? He might not able to travel back immediately for any USCIS request. Not sure how much more GC will take time. 

 

Vermont is sleeping again i guess :( 

If he misses the fingerprints appointment  his case will be considered abandoned , if they set up interview and he is not here then he can ask Uscis to reschedule the interview.

They won’t ask a waiver because your asylum case was denied. For sure they told you the reason, most likely is misrepresentation, but you must know the reason why they asked the waiver in order to file the correct waiver .

the country I’m processing my visa in has a massive backlog in processing cr1 and ir1 visa, currently at 8 month delay to get the cr1/ir1 visa. But they almost have no one getting the ib1 visa (based on vawa) very rare 
 

so im wondering, does this mean I might get an earlier visa interview than the ir1/cr1 visa applicants since the they are different types within the family category, or will it be the exact same priority and wait as the ir1/cr1. There are a huge amount of people processing the cr1/ir1 at this embassy but no one at all processing ib1. 
 

anyone have an idea if it will be different in the queue since they are 2 different types of visa within the family category, or will they be the same because they still consider them all as immediate family category? 

You will come to the U.S with lB1 visa, if your vawa was approved.

Usually when the person has two first names like her, they write the first name like they wrote ok.She will be fine.

I think I know what has happened, when I was submitting the enquiry with the congress person they asked me to use my only name in both first and last name and after that enquiry USCIS have updated my name. I am so confused now.

File with your correct name and send a letter explaining their mistake. You have to ask them to fix your name because they messed up big time .

They are taking 6/8 months to issue the work permit.Now you just wait for your work permit and Aos interview, in some cases they waive the interview.

I received a RFE for misrepresentation, honestly, it is not my mistake, I had some address issues and i received an RFE for the same during my VAWA. I explained it to them and VAWA was approved. Now for 485 they issued 601 RFE. Shall i be apologetic and reply or explain them about misunderstanding?

My 485/vawa is with local. in that case where i need to send my EAD/AP renewal? I am in process to reply to 601 RFE which will go to Vermont then NBC and then to local. In my case where shall i send my renewal?

I have not sent any medical exam .are they gonna waive the interview without asking medical in some cases still? I have work permit under Vawa expire till 10/24/2024 . It’s c31 . I have also removal proceeding which is administratively closed . I really want my journey done with successfully but waiting makes me so tired and anxieties.

I think you need a lawyer. Misrepresentation and I-601 is not a walk in the park. One wrong move and you'll get denied and put in removal. One wrong move and you'll never be eligible for any immigration benefit in the US.

Hi fam, I am 41 months in (Feb 2020) and had to reach out to my Senator's office and a response came last month that it is at background check. I will encourage you to reach out to your Congress person/Senator as well. After waiting this long, I will encourage you to hold on to hope. Let's look at it this way - when your VAWA is approved, you get a 10 year green card whereas if you started the process afresh, you first get a conditional green card (2 years) and also back to relying on someone for your status. By filing for VAWA, you took your destiny in your hands which I believe is a brave thing to do. Do not despair fam, your day is coming soon.

Get those proceedings terminated, USCIS technically doesn't have jurisdiction over the I-485 while you're in removal proceedings. Best that you could get from them right now is USCIS admin closing the I-485 until you get a termination or until you file with the court instead.

 

Anyways - the way that it works for missing medicals is this:

If USCIS chooses to waive the interview they will RFE you for it.

If USCIS chooses to interview you, you bring the medical with you to the interview.

 

 

Anyways, while we're here, has anyone gotten an interview waived after an EWI?

Contradictions without citations only make you look dumb.
