Between getting I-360 receipts and your EAD, you might need a non-working SSN to apply for state or federal benefits. I could explain further, but google does a much better job.

I guess that is the reason why USCIS issues prima facie determination in the vawa process.

Why not just wait for that?

You are talking of being qualify for State or federal benefits after submitting your form I-360.

So, vawa filers do wait for their first prima facie.

With that, they are entitled for those benefits.

I personally don't really know that much about the "Non working SSN"

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hi everyone 

I filed i360 in feb 2020, rfe in April 2020 and I replied. No action till April 2022 - another rfe  and I responded May 2022. No action again until Feb 2023 - Correspondence Was Received And USCIS Is Reviewing It. And nothing again since then. I’ve done ombudsman and Congress and still nothing. Pls what else can I do? I’m out of my mind at this point.

 

I’ve been unable to work because my lawyer did not file i485 and I couldn’t get EAD. I just want my VAWA approved so I can start working and move on with my life. 
 

pls what options do I have, what else can I do to get my VAWA approved?

So sorry to hear that.

I was also a February 2020 vawa filer.

You should have filed a form I-485 concurrently at the time if you were married to a US citizen.

That would have enable you to be working and even traveling outside the country while waiting for vawa approval.

As you said have tried the congress and even the ombudsman without any success, the best thing is just to wait and continue praying for God's interventions.

But it is not too late to submit your form I-485 with a fee waiver if qualified.

So, you will then save a lot of time than to continue waiting for the approval before filing.

What do you have to loose?

Do not forget that you have another option to submit a service request of your case outside of normal processing time when it's due.

I did. But the i485 & i130 got denied. It was reopened after my first lawyer filed an appeal. My second lawyer that filed my i360 submitted that i485 receipt with my i360. I applied for EAD renewal twice and got denied, I never got the denial notice, my lawyer might have gotten it but he didn’t share with me. Apparently the initial i485 could not be used as it was denied and even though it was reopened after the appeal. I only just found that out in Dec 2022 when I used a new lawyer to file i765 again. So I had to file a new i485 & i765 in Dec 2022. I’m still waiting. I’m just sad that this could have been avoided if my lawyer has cared enough to look at the denial notice and informed me about filing a new i485. I’ve been unable to work since 2020, I’m depressed and I can’t even talk to anyone because not a lot of people understand this process. I have health issues now, I was diagnosed last year 2022 and I can’t even afford to pay for treatments, I’ve been having to pay out of pocket. I’m so tired. I’m so sorry if it feels like I’m ranting, I just needed to let this out.

For the new forms ( I-765, I-485) , you are still in the normal processing time.
