06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hey everyone, my PF is expiring in two weeks… I never got a new one. Is it a bad sign? 

On October 28, 2022 The Post Office returned a notice we sent you for your I-485 because they could not deliver it. 

On October, 06, 2022, Card was picked up by USPS

On October 3, 2022, we mailed your new card for your form I-765, Application for Employment Authorization 

On September 30, 2022, we approved your form I-765, Application for Employment Authorization 

On September 29, 2022, we ordered your new card for Receipt #_________, and will mail it to the address you gave us

On August 25, 2022 we updated your date of birth for your Form I-765, Application for Employment Authorization 

April 14, 2022 Response To USCIS' Request For Evidence Was Received

March 15, 2022 We received your correspondence for Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant.

March 14, 2022 We sent a request for initial evidence for your Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant.

July 26, 2021 We received your Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant.

Nope.

It's not a bad sign neither a good one . They sometimes forget to send it.

You can still send them a letter requesting a new one.

In that Mail do not forget to add a copy of your receipt notice of action, your ID and a signed cover letter requesting the new PF.

NO matter if RFE was in or not, you have grounds for I-290 B… full speed ahead . Within a few weeks you will know if filing another I-485 is warranted. 

I just checked both packages, she did not include the RFE NOTICE in both packages😭😭😭😭😭 that’s why uscis returned it as not needed I think. I don’t want to be rude to her, what should I do?

After I emailed her about that the reason why my i601 was returned because she didn’t include the rfe in it and didn’t include it in the package to the local office, she responded like this “We do not include an RFE notice when filing an I-601. Would you like to find another attorney to represent you? You seem convinced that this is our mistake. If your trust in my work or my office is broken, I cannot continue representing you"

Please remain calm and make sure you're not overly emotional in your email communication. Do you have copies of everything submitted? If not, try getting everything ASAP for your records.

 

You can also gently remind them that you can file a bar complaint in case if the issue is not fixed for free or the fees are not refunded to you.

Yes I ask them to send me everything they mailed to Vermont i601 office and to the local office. And realized that they didn’t include the RFE notice itself in as per @Family advice . @Family advice me to check for that and the rfe was not included indeed. So my lawyer saying they do not file i601 with RFE. I asked her how uscis office will know that I have an RFE for i601 if the notice wasn’t included? And I told her that that is the reason why my application was returned with letter saying that “ the i601 is not needed at this time”

In the I-290 B , focus only on the proof of mailing and show the receipts ..do not mention the missing RFE. Worth the effort and the filing fee…

 

After you file I-290 B , you can file a state bar complaint and yes do ask for your $$ back.  In your complaint also highlight the reason she “ fired “ you as client after you brought up her error that resulted in denial..it’s unethical.

This is the stamp I saw on the returned i601 form . What does it mean? They returned it accompanied with that rejection notice saying “they do not need the application at this moment “

Her assistant sent me both packages they mailed to local office and Vermont . I have a copy of them. Maybe she may refuse to give me the original

I believe every RFE contains language that instructs to include copy of this w response. try reading through yours..that applies both to I-601 and receipts mailing to Field Office.
