To me it looks like they are not aware of your I-360 approval, not being an expert on this I will let @Sandra G. to comment on this.

That's what I thought too although them saying that I confirmed that the application was correct made me a little scared in the first paragraph.

 

If that interpretation is correct (that they are unaware of my i360 approval) is it better to motion to reopen with the evidence or file a new i485 petition? Hoping for whatever is faster and more likely to be approved. Field office for new application is NYC, this rejection is coming from Miami field office (I used to live there) @Sandra G. I only have 2 days to respond if I were to reopen.

It’s been almost year since I became a US citizen. The interview for me consisted of basic questions from the N-400 form I filled and the civic test. No one questioned me about vawa. It was a simple and quick process.

They are not required to hold your 1-485. They denied it because you were no longer with spouse and did not bring proof of filing VAWA. 
 

just file another I-485 with medical.

His I-485 was denied in 2020. His VAWA not approved til 2022.

If you no longer live in Miami they cannot approve your I-485. It will have to be transferred to New York.

I literally brought my filed VAWA package to my hold in abeyance interview lol but maybe you’re right to file a new application it’s just I don’t want to go back of the line again

The only proof they accept is your receipt of filing. Showing them a stack of papers means nothing. 
 

Actually refiling will be quicker. Your file will clear quicker because all of your information is current.

I think make an infopass appointment and take with you your i360 approval notice and i485 receipts. They may fix your issue without a motion to reconsider or to reopen. And also get your i290b motion to reconsider ready. If they say file a i290b after your infopass, go ahead and file it. But go to your local office first

I’m also not able to schedule the infopass because my application is under VAWA and all they tell me to do is to call Vermont..

There is nothing to reconsider. He had not filed for VAWA at his appointment. He admitted no longer with spouse. His VAWA was approved in 2022. Two years after it was denied.  
 

The only way he can ask for reconsideration was if he filed for VAWA prior to October 2020 date and his receipt reflects that date. 
 

Furthermore. USCIS does not have to hold your I-485. There is no requirement to do so. The IO adjudicated it appropriately. 
 

You are going to spend money and resources for your reconsideration to be denied in another year.
