Another phone call failure :( I just called the Infopass and they said the same thing. They can not see the file so they want me to send a mail to USCIS Vermont address. I tried to explain my case and pushed the agent to give me a chance to visit but it did not work out. Any suggestion? Should I send a mail to Vermont? I feel they will tell me the same thing they told my congressman. Background security check.

that is so messed up. 

try to chat with them through emma. second if you make a phone call again tell them you want to speak to tier 2 officer then explain your situation.

Do I start shopping for a new lawyer? I’m in removal proceedings but My I360 was approved in feb 2023. Prior to my approval my lawyer had filed PD but got no response. We tried a second time after vawa approval in feb, but the response from OPLA was they had more than 300 cases ahead of mine and was attending to them FIFO. After applying pressure, my lawyer eventually filed a motion to recalender/terminate proceedings directly with the court accompanied by a new I-485 in MAY! Last update I was given in July is “the judge wants us to file another I-360 with him” which sounds very weird. It’s been 4 months now and nothing, I’ve been calling and messaging for updates for 3/4weeks now and my lawyer is ignoring me. I’m in TX as well and I do not have any record, I thought termination was easy😩. I’m beginning to feel Tx is just notorious when it comes to termination cos I’ve heard people successfully terminate removal in other states with pending I-130 or I-360 and it’s difficult here even with an approved petition.

The fact that OPLA/ICE doesn’t respond or says wait..is common. It’s fantastic that you got attorney to file motion to Recalendar/ terminate w the court! Hopefully you have a copy of it, if not get one. 
The I-485 filed w the Motion won’t get traction since goal is terminate and Run…not schedule future hearings to adjust in court. 
As long as you can independently verify motion was indeed filed , nothing you can do but wait for the court. Texas is a border state..so you can appreciate the backlog.

 

Nothing a new attorney can do ..and not worth $ to switch , now that work needed ( Motion) already done and filed. 
Turn on the Texas charm you picked up , call the court , make nice w the clerks and try to see if they can guesstimate a date .

I’ve been to the court 3 times and on each occasion I was told to ask my lawyer for update as they see I have one on file! Is there a way I can get the direct contact for my judge’s clerk?

there's list of EOIR's judges all around US along with their assigned clerk. i just cant remember where did i get it but i download it. just shoot me PM if u have the name of the judge and where is the location

Thanks for the heads up my friend! I did a live chat with the officer. attached a photo of what he said. I asked him if the tier 2 officer has access to the Vava files, and he said they have more access. Do you think the Tier 2 officer can give me any feedback or I just stop pushing and file the Mandamus action? :(

no tier 2 will not have much access either. Just him/her for the appointment.

Yeah you should, like your lawyer obviously doesn't understand how any of this works. I especially don't understand the new i-485 since there's no good reason to file that with the court while seeking a termination.

 

Like immigration judges have no jurisdiction over VAWA I-360s under any circumstances. The only response to a request like that is that it's improper or straight up file EOIR-29 because the judge is obviously incompetent and have the BIA give you a termination instead.

 

Contradictions without citations only make you look dumb.

Background security check is unfortunately something you can't jump over. That stuff rests with the FBI, USCIS has no power to push it along and congressmen aren't too keen on inquiring with the FBI.

 

The reason why infopass went nowhere is due to the privacy protections in VAWA. In theory they are supposed to prevent any unauthorized party (especially the abuser) from getting information, but in all reality those things just make any kind of follow up with USCIS difficult. There's a reason why "ask your congressman to inquire" has become the standard procedure in this thread.

THE SPECIAL CUCKOO CLOCK

 

The other night I was invited out for a night with the "girls."  I told my husband that I would be home by midnight:  "I promise!"

 

Well, the hours passed and the margaritas went down way too easily.  Around 3 a.m., a bit loaded, I headed for home.

 

Just as I got in the door, the cuckoo clock in the hallway cuckooed 3 times.  Quickly, realizing that my husband would probably wake up, I cuckooed another 9 times.  I was really proud of myself for coming up with such a clever solution in order to escape a conflict.  (Even being so drunk, I figured 3 cuckoos plus 9 cuckoos = 12 cuckoos = MIDNIGHT!)

 

The next morning, my husband asked me what time I got in.  I told him "MIDNIGHT."  He didn't seem angry in the least.  Whew!  I got away with that one!

 

Then he said, "We need a new cuckoo clock."

 

When I asked him why, he said, "Well, last night, our clock cuckooed 3 times, then said, "Oh, [bleep].  It cuckooed 4 more times, cleared its throat, cuckooed another 3 times, giggled, cuckooed twice more, and then tripped over the coffee table and farted."

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Just called USCIS to schedule an Infopass appointment and it turns out we are not eligible for appointment since our cases are based on special situation. They said to mail Vermont my question

It’s very sad to hearing that . Someone already has approved and the judge asks to file another one with him what an absurd … I wish you will find a way to terminate your removal and get your done 485 quickly .. 🙏🙏🙏

 

 

I will attach here my court letter on there some ink by judge was ordering what we should do . The judge was not receipt any my I-360 receipt  that time my attorney was telling I will send it to your honor .. etc and judge said we can’t deport this guy on going situation in his country so next hearing I want to see these I-485 or I-360 to terminate his removal . After hearing even my attorney told me that when we will get approved we will present it to judge and ask termination and then we will submit I-485 in court but now wait wit wait .. even no receipt judge administratively closed my removal .
