Hi all,

I got my Green card in December through VAWA, and I am working on submitting application for my 2 children. I am confused on how to achieve this, and I will appreciate if you can guide me on this by answering these questions:

What form should i submit at this stage for them to also have Green card

Can I start the application now (Just 4 months after my green card)

Where will I send the application to (NBC or Vermont)

What is the application fee per child (Children are aged 14 & 12)

What documents do I send with their application?

Do I need to fill in the affidavit of support for them (Form I-864)?

Please help me out.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

It is Wednesday and time for our Semiofficial Semiweekly VAWA-Thread Joke, to bring at least grins if not also good news:

=============================================================

A HARD MONTH

A man walked into the bar and saw an old friend of his, drinking by himself.  Approaching his friend, he commented, "You look awful. What's wrong?"

"My mother died three months ago and left me $150,000," the friend answered.

"Boy, that's tough," the man replied.

Continuing, the friend said, "Then, two months ago, my uncle died, leaving me $50,000."

"Gosh, two relatives gone in such a short period of time?  No wonder you're depressed," said the man.

"Last month, my brother died and left me $10,000," the friend added.

"That's a lot to deal with.  Losing three close family members in three months is terrible!" replied the man.

"Then, this month," continued the friend, "nothing!  Not even a single dime!"

:P

Are your children in the US or in your home country?

The board will decide if your authenticity of divorce certificate is valid. If your divorce is not valid then you do not qualify for VAWA.

Hi @sandranj I submitted the N-400 a few months ago but did not submit tax transcripts. I did biometrics and the online status says "Actively Reviewing" since then - should I upload the transcripts in the Unsolicited Evidence section of the USCIS account or just wait until the interview? I'm just wondering if that delays the scheduling of the interview by a lot. Thanks for your help!

Vawa Law is protect by privacy law, that being said you can tell the judge you have “a petition pending with the Uscis”..If the judge asks a copy of the petition or what kind the petition you submitted then inform the judge your petition has a non disclosure provision therefore you can’t disclose about your case.If the judge continues insisting tell your attorney to ask the judge for a side-bar and he should inform the judge you are a victim of domestic violence and enforcement acts are prohibited at courthouses regarding VAWA self-petitioners.

Hi Sandra,

I know the I360 immigration officer needs to ignore all false claims by the abuser but what if the abuser contacts the IO that is interviewing you for the GC and feeds him/her lies? I know they do not have as much training as the I360 officer on vawa, will they also know they cannot listen to anything the abuser says to jeopardize the GC applicant? Thank you so much for answering my questions.
