Hello. I am pretty new here. Please I have a question: how do I apply for VAWA without having the SSN, Birth certificate or Passport of my abusive spouse? All I have is our wedding license/certificate and photos. It is possible this has been asked before so please forgive me for asking again, as I could not find it in any of the previous threads. Thanks for your helpful responses.

CAN'T SLEEP HERE!

 

Three friends -- a Rabbi, a Hindu holy man, and a lawyer -- had car trouble in the countryside.  They asked a nearby farmer if they could spend the night.

 

The farmer had room for only two to sleep, so he said, "One of you must sleep in the barn."

 

The Rabbi volunteered, but soon knocked on the farmhouse door.  "There's a pig in the barn, and pigs are unclean, so I can't sleep there."

 

The Hindu holy man volunteered to change places.  However, he too soon knocked on the farmhouse door.  "There's a cow in the barn, and cows are sacred.  I cannot sleep on holy ground."

 

The lawyer grumbled and complained, but he went out to the barn.  Moments later, the farmer heard a knock on his door and opened it.

 

It was the cow and the pig.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I don’t think it’s everyone that’s required to bring in the Medicals. They might not need it if everything looks good on their end. Else they would have requested it. On the other hand they slip up sometimes. For the interview, you can go through your I-485 form and also the I-360 petition one more time just incase they ask questions concerning the case. It’s not supposed to be so but we’ve heard of officers being overzealous. Best be on the safe side. Go with all the original documents pertaining the petition. Be confident, the hard part is done.😊👍

The interview case status update was actually them requesting for medicals from all of us.

USCIS requests Medicals but pay attention to the instructions pertaining to it. Sometimes they ask that you bring it with you to the interview and other times for you to send it in by mail. It’s two different instructions which should be adhered to in other to avoid delays and confusion.👍

This process is long, draining, and still ongoing for me but i am grateful it has helped me find myself again even though that felt impossible at some point just a year or two ago. We just all need to hang on a bit longer, this story will have a happy ending for us.

I’m so happy that you’re in a good place in your life. Please do not entertain the past ones. They’re called “past” for a reason.

You can write an affidavit stating you don’t have any of these and request USCIS to check their databases for him. That’s if he’s ever applied for an immigration benefit. Be sure to write his full name and DOB. Good luck in this journey. Its a tough one but with enough support you’ll get through. Read these VAWA threads all the way from part 10 and you’ll be equipped to handle your case yourself. Also, always ask anything regarding the petition here. We are a group of folks who help each other.

Mailed out my EAD and AP renewal and paper AR-11 on Feb 18 and USCIS received it on Feb 21.. I moved into my new place on March 1 but the problem is my new place does not have a mail receptacle yet and I just learned that USPS has been returning all my mails to senders... my question for the group is how long, on average, does it take for USCIS to mail out receipt notices once they have received your application forms and if receipt notices are indeed returned to USCIS, what should I do?

Yes in the letter they said that the i-693 was the last thing needed in order for them to make a final decision. Very happy since this means  an approval once we all complete the medicals hopefully. Such a long and stressful journey hopefully ending this year.

FYI

I mailed out my EAD and AP renewal on Jan 28 and someone picked from USPS on Feb 8. I got email from my lawyer just now that we received the receipt notice for your I-765 petition.  This is really very frustrating that USCIS only send the notice for 765 and not for 131 and class requested is C09 when I put C09P in my 765 application.. Yet they took 3 weeks to generate the notice. I guess I have to wait for 131 notice.

Did you file a motion to terminate the removal ? .In order for the USCIS to adjudicate your case the removal must be terminated prior Uscis adjudication.

Usually Uscis issues the receipt within 30 days , but I had some cases they took 4/5 months to send the receipt. USCIS IS VERY MESSY to update the address .Contact your congressperson to confirm if Uscis changed your address or not .
