Thank you all!
 

I am panicking again, looking for some advice. Got GC approved, wanted to book international flight for a couple of weeks and go see my parents.

 

I unknowingly violated my prior immigration status years ago, I mentioned it in my 485 application, it was cleared recently, and I got GC approved.

 

My question is: Is it safe for me to travel now? Can I be still denied entry? What are my options if they don’t let me enter.

 

If anyone knows about it, please let me know or guide me to a document or something, I would really appreciate it.

What kind of violation ? If it’s clear I don’t think it’s gonna be an issue otherwise you won’t get ur greencard.

Was accused of fraud/misrepresentation which was the reason for multiple interviews, prior denial, and delay for years. I have always been truthful about it.

You already got the greencard after that, u are good to travel

Timeline

Multiple questions in one post. 

 

1. My friend. (Timeline: full packet: OCt 2020, I-360 , Vawa approval Sep 2022) fingerprints for 485 applied Oct 2022, His Medical was October 2021, asking if he can send medical even before they send RFE. he is getting mixed response, some are asking to submit the medical only once he get RFE for it, some are suggesting to send new medical. What you guys recommend? 

 

2. What is the longest you seen someone took to get their VAWA approval? 

 

3. My case is stuck in background check, is their anything i can do from my end to get it cleared? or send any documents that could help USCIS. I was contemplating to send FBI, my home country police clearance certificate and all. 

 

4. Recently, my mom's tourist visa been rejected, anyone able to get tourist visa for their parents? My mom been to more than 15 countries in last 3 years. Their all questions were focused on me and my status, they were not able to see any details regarding me because of VAWA. As stupid as i sound, i did not send my VAWA details with my mother, She is planning to apply again and take my VAWA receipts with her this time. any other suggestions that might help? Its been 8 years i saw my mother. I was thinking to writing to USCIS Vermont about my mothers tourist visa refusal due to my VAWA secrecy and ask if they can help validating it with US consulate general. I know it is not normal, but would it be very bad move? this sepration is taking toll on me. I have AP but i am very scared to travel as anytime they can decide on my case. I already had 2 RFE's 

 

Looking at processing time, i am started getting depressing thoughts that i might will never see my mother in this life time. Please help.

1- No why would you send the medical exam before uscis ask for it you can't force them to approve your case just wait and see their response 

 

 

2-it depend each case is different it can take upto 5 years if you not lucky enough 

 

 

3- ask your congressman to do inquiry on your behalf they can help in this situation 

 

 

 

4- it's difficult for your mom to get b2 visa she becomes a potential immigrant, the way I see it when you become USC you can sponsor her

1. Never send medical without RFE letter from USCIS. Just wait for RFE to come then decide if the old medical still valid or not to send. Until then, just wait 
 

4. Ur parent can only apply tourist visa on their behalf. You can’t apply or sponsor for them for tourist visa. Normally if your parents can show strong ties with their home country the bigger chance for them to get tourist visa than told the consulate / embassy about ur vawa status.

I am about to hit 3 year mark, so may be 2 more years or less hopefully. 

congressmen said my case is in background/security check.

Thanks for your help, she did showed strong ties, but all questions of VO were focused on me and my status, they were not able to see any of my details in their system, they found it suspicious and denied her visa. :(

Have the same problem. Filed 2020 dec and still nothing. My mom and dad have usa visa but when my brother applied 6 months ago they denied his application. We are from turkey and I got him another interview in bahamas and he will say we have cruise tour from Miami w dad and mom. Should he bring up my vawa case or talk about it? Should I send him some paperwork:( I don’t wanna travel to turkey w ap cuz I don’t wanna take risk:( so hard. It’s been 8 years

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Absolutely not. Your brother's tourist visa application has nothing to do with your WAVA and mentioning it can only make things worse.
