Filling out the I-360. I-130 was filed for me in August. I-130 contains a complete set of bona fide marriage information. What should I include in the I-360?

(1) Complete I-130 and I-130A and supplemental docs (over 35 pages)

(2) Only the 797c receipt notice for the I-130 (IO would have access to the I-130?)

(3) Selected information from the I-130

(4) Additional information beyond the I-130 that supports bona fide marriage after it's submission in AUG.

You don't have to submit any document regarding your form I-130.

How do you file the mandamus? I think I should do that my VAWA was approved since sept 2019,had interview March 2022,they re-opened my case and nothing, they say they are doing background checks but they did not order for fingerprints. It’s so overwhelming for me.. tried congress man and all that but still nothing happening.

You should hire an attorney to file the  mandamus. It's very complicated the writ of mandamus.

Background: I am still living with my USC spouse.

Thank you sandranj. I have all of my information, except the psychological eval, which I just started and I'm looking a 2+ months to complete. I have a police report and I suffer anxiety and nightmares as a result of the extreme cruelty from the incident in the police report. Lawyer says I have enough for PF.

I am being advised to file for VAWA now, as I need medical and EAD to move on from my situation. I then would update my I-360 with the psychological eval as soon as it's completed. This makes sense to me.

Even though you can file I-360 with your spouse, you should at least be separated when you go for your AOS interview due to the fact that VAWA is for abuse victims who are fleeing abuse.

sandranj had the intent of my post correct - still married and living with the abuser.

Still, I have read and watched videos where the status (married, separated, divorced) doesn't matter for VAWA. That specifically somewhere in the statute it says marital status doesn't matter. Couples reunite all the time for all kinds of reasons and congress didn't want to dictate that the couple had to separate or divorce.

I am stll living with my abuser, i just can affort to move out even with the prima facie, i just keep getting more prove for uscis in case they ask for it. Its hard to divorce and vawa doesn't ask you to be. Please just trust your process

Hello Family, I hope everyone is doing alright. I have couple question,

I had my combo card approved March 11-2022 and then Vawa approved in May 2022.

I travelled on Combo card for a month April-2022 to May 2022.

do you think it would be alright to travel again for a month, January 08-2023 to Feb 14 2023, before the expiration or should I wait for my I-485, which shows case was transferred to NBC on September 16-2022 then a they issued a defiance notice on October 5th 2022,

I have not applied for renewal of travel documents yet.

Any suggestion would really help.

thank you

Sorry, I meant to write Deficiency notice for medical. it said, on the initial review, we noticed  that medical was not submitted with original petition, so you will either need to bring it at interview or we will ask for it, there is no need to do anything at the moment.

Yes it is alright to travel again. I personally travelled multiple times. Since your VAWA is approved. You are good to go now.

No, if you really prove it with photos, letter etc it will be fine.

Same as people seeking asylum going back to their countries, e.g. it doesn't help. In WAVA case good evidence would include police reports, licenced mental health therapist, affidavits from witnesses of abuse, docs from specialized shelters showing efforts to protect themselves. If a WAVA seeker lives with abuser and doesn't take any steps to protect themselves from abuse, IO can rightfully doubt the case. At least that's my understanding.
