Hello friends.  I'm wondering when we submit vawa case does immigration do a security and background check on the applicant?  I'm not meaning  to the 485 form, nor good moral character.  Because when the case out of the normal processing time , the immigration responds that a case is under security check on the 360 form.  Is this really true or is it just a standard answer that uscis  writes to everyone. I have seen that they have a similar response on the 485 form as well, that 485 case is under security and background checks . Do they make the checks both applications separately?

They verify the information that you submitted to prove abuse, living arrangements, and all documents that you submitted, including bank accounts, utility bills, leases, among others.  

Phase I - IV - Completed the Immigration Journey

Timeline:

July 2019- Filed I-485/I-130/I-131/I-765

December 2019- Combo Card Received

January 2020- Interview Scheduled

February 2020- Filed I-360. Asked USCIS to hold I-485 in abeyance

March 2020- USCIS receives application

October 2020- File for renewal on I-765/I-131

February 2021 I-765 renewal approved. Somehow, I-131 renewal has been separated.

October 2021- Still no I-131 approval. File for 2nd I-765 renewal

February 2022- I-131 approved (16 Months Later!!) Paper Copy w/photo. Not Combo card

May 2022- RFE (Didn't submit Psychological Evaluation with my I-360, as (former) attorney said that a letter from my therapist was adequate.

 

August 2022- Correspondence has been received by USCIS (PsychEval)

 

September 2022- 2nd I-765 renewal approved (2 Year Validity)

And finally, today, November 30th 2022- I-360 'We Ordered Your New Card'

It's been a long long road with lots of worry, stress and anxiety. Now I can finally take a deep breath. Feels like the weight of the world has been lifted off my shoulders.

Thank you to everyone in this group for sharing your stories. It has given me something to stay strong throughout this difficult process.

For all those still waiting, I feel your pain. Your day will come soon, and you will feel the joy that I am feeling today!

That's why I asked.  If only the submitted evidence is checked, and in my case I have sent everything.  So what does a background or security check go to forever? Security checks is going since 10/21 till today and I believe forever, I don’t understand. Why never asked me RFE. I’m waiting my decision almost 3 year and nothing is heard from uscis

Does anyone know the average time in between receiving the deficiency notice and the RFE letter to send medicals? They mailed the deficiency letter on 11/8 to my lawyer's office. I'm wondering if they sent the RFE letter and she hasn't told me yet or if I'm just being impatient lol (or if I'm going to have to interview 😕

 

Also, I hope everyone is hanging in there. Tons and tons of people (on Reddit) are getting approved even though they filed after me - one filed in July and 485 got approved yesterday lol. I'm definitely happy for them but I wish it was me too. I HAVE to believe that our time is coming soon!!

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Vermont sends the case to NBC and the NBC ships to the  local office.

Will he meet the requirement for filing WAVA in his situation? He asked some attorneys already. Some said could, some said could not file for WAVA.

That made him confused.

Cheating is not ground for VAWA .He must prove psychological abuse to have a VAWA petition approved, and he needs a diagnose of depression and/or PTSD due to the abuse suffered.It won't work if he is diagnosed with depression because she cheated on him.

You must mail your form AR 11 to Vermont. Even if you got your GC.

So it turns out that after you get your GC, you’re NOT required to go through VSC anymore in terms of updating address! They returned my package and instructed I’m free to up update it online. Just like they sent to you! So yeah..had to find that out for myself to be sure! Satisfied now!😊👍
