SSA was wrong - they were in fact asking applicants to break the law. The law is very clear.

Per US Law, Immigration and Nationality Act section 264(e)

Quote

(e) Personal possession of registration or receipt card; penalties

Every alien, eighteen years of age and over, shall at all times carry with him and have in his personal possession any certificate of alien registration or alien registration receipt card issued to him pursuant to subsection (d). Any alien who fails to comply with the provisions of this subsection shall be guilty of a misdemeanor and shall upon conviction for each offense be fined not to exceed $100 or be imprisoned not more than thirty days, or both.

 

Some SSA workers are not knowledgeable about the INA laws and make the request/demand because per SSA policy only originals or certified copies from the issuing agency/department are accepted.  If anyone faces one of these people at SSA they should quote the above US Law to them.

 

When we had to get a SSN for my wife, the first agent we spoke with on the phone told us to mail in the original documents.  I did not know the specific law at the time to argue effectively.  We called a second time, and this time the agent told us to mail in photocopies with the SS5 application and they would schedule an appointment at our local office for us to show the originals.
