DS-260 Form

I am filling out form DS-260 required by the NVC  for my 2 Stepchildren.  On the “Family Page” the first Question is: “Surname of Father”.  For both of my Stepchildren their Birth certificate excludes the Father’s Name.  Their Father has not contributed any support for the youngest and was a very poor provider for the first.  Once my wife became pregnant with her 2nd child he disappeared.  While they are my Stepchildren I have not formally adopted them though I plan to once we get to the USA.

What is the correct response?  Their actual Father or me the Stepfather?

I hope people this is my last question.  Thanks all.

Not you. If USCIS asks for proof you won't be able to deliver.

If the biological father is not showing in any documents unknown might be a possibility but I'm not super sure about that.

The Father is certainly unknown to the children but of course he is known to their mother.  That’s why we don’t know how to answer the question.  The 8 yr old last saw him when she was around 3 yrs old.  He disappeared when their mother was pregnant with the youngest who’s now 6 yrs old.  If anyone asked either of them who their father is they would say me.

Actual father.  The DS-260 questions are pretty literal in nature.

My apologies. I know I’m doing this wrong.

I tried going through this Blog to find an Attorney to answer one question.  Of course I will pay but they all seem to want to review the entire Submission for $500 or so.  Does anyone know the answer to my question below?  My original post is below but not stated very well.  I’ll try again.

I’m filling out separate DS-260’s  for my 2 minor stepchildren ages 6 & 8.  On the family page the question is “Name of Father, Surname, Given, etc.”. The answers are easy fill in the Blank except the Fathers name is not stated on either of their Birth Certificates.  Additionally my Wife doesn’t want to list his name because he hasn’t been a part of the children’s life or paid a dime in support.  One option to answer is “Unknown”.  I don’t know how that could pass the NVC bc who doesn’t know the name of the father of 2 children?  Is my wife supposed to answer with her knowledge or answer as if the children were answering?  Obviously they don’t know anything as they think I’m their father.

if you can help, great or if you know an attorney that I can pay please let me know.  Thank you.

"Unknown" is an acceptable answer when it is the truth. Misrepresenting the truth is never a good idea.   Why not enter his name as the father, then enter "unknown" for the details?

No, I’m not suggesting I say I’m the father.  I’m saying my wife didn’t list him on their Birth Certificates and she doesn’t want to list them on the DS-260.  She would rather say he is “unknown” bc he isn’t on the BC.  I think she needs to list him but she doesn’t want to acknowledge he even exists.  I just need to do the right thing bc we are so close.  Thank you.

I have decided that we need to list the actual father.  My wife is a bit emotional about it but as Crazy Cat said or words to the effect the truth is always the best choice.

We are hoping for a quick response.  If you recall I’m the guy who didn’t file separate I-130’s for the kids until one year after my wife’s.  I contacted my Senator who contacted the USCIS and after filing their I-130i’s on June 30, 2022 the USCIS  approved them on September 14, 2022 and I paid the $325 each to the NVC on September 17, 2022.  I don’t want to mess this up after the Senator pulled a rabbit out of a hat.

Thanks to all.  Thanks Crazy Cat. After you responded she acquiesced.

I understand I’m an technology idiot.  My apologies.  Years ago when all this email stuff started for me I had a secretary who took shorthand and a tech team that handled every hiccup on the tech side.  Consequently I never learned.  Both my ex wife and my current wife take care of the heavy tech lifting for me, I just stumble through  life trying not to piss of the tech, email, spelling and grammar Nazi’s.
