Hi everyone! It's been a whiiiile since I posted here - I finally have a date for my interview for citizenship (in 45 days). We don't have a birth certificate of my spouse (US citizen by birth), been lost somewhere at his parents house. And we've always been able to submit his travel passport instead (K1, conditional residency, removal and the original citizen application). Now, in my notice about the interview, it only mentions his birth certificate that's a good proof of his citizenship. Has anyone had experience using their US spouse passport at the interview?

Thanks!

It's almost certain USCIS will ask you to prove your spouse was either born (birth certificate) or naturalized (naturalization certificate).

You can request a copy

I've just gotten it ordered but it takes up to 60 days which might not cut it for the interview....US travel passport does have place of birth listed which is why it was allowed as proof on every stage if the process before this. Thank you though!

YMMV. At the  I-485 interview, I had to produce my original naturalization certificate.

I think it is probable you won’t need his BC.

@stacyt did you ask to expedite it?

Wasn’t an option. They said in California it’s all about the records office and how fast they move. Can be 2 days and can be 60

I do not have a birth certificate.  We only submitted  my passport and I do not have my naturalization certificate either.

Spouse is now a US citizen

@chi6488 you won't have a US naturalization certificate until you get your N-400 approved. What USCIS need is your US citizen spouse birth certificate or naturalization certificate to establish how they became a US citizen.

Your birth certificate (immigrant) is even more important to them. So you gotta try to obtain it somehow or prove you cannot get it.

P.S. Sorry if I misunderstood your message. Are you saying you went through the whole process without showing US citizen birth certificate or naturalization certificate?

Congratulations! Did IO ask any questions about these documents? And which field office was your N-400?

Not one question was asked.  I have used the Passport since the K1 application.

No question.  Pointing out to the op a birth certificate or naturalization certificate is not needed to show US citizenship and or birth certificate is needed

It’s like me pointing  that that I can drive 83 mph  in a 75 mph zone because the Arizona state trooper parked on the medians  to chase speeder doesn’t go after me.

Or 20 of us drove 90 mph past the trooper and he only stopped 1, so the fact that 19 got away with it means it’s ok drive 90 mph in at 75 mph zone.

Anecdotally my wife was not permitted to adjust status until I produced my naturalization certificate. I’ve even seen cases where the IO not only required the naturalization certificate but also required the citizen’s foreign birth certificate.

Now I grant you that most times an immigration benefit will not be denied  if only a U.S. passport is provided.

Just like most times I can speed, not need fire insurance on my house, etc.
