Hello, I am the USC petitioning for my husband, we are both overseas. I am employed overseas and so I know that my foreign income does not count and I should put $0 in item 7. However, last year I rolled over an IRA to a Roth-IRA (the account is based in the US), which is a taxable event and it is income according to the IRS and I paid taxes on it and it shows up as income on my tax return. Since that income was in the US, should I include it in item 7? The instructions for the I-864 say "annual income that you are using to meet the requirements of this affidavit..." and so I think that I should not include the "income" from the rollover because it's not annual income, but I would like to double check for peace of mind. The roll over will show in the tax section, not as current income.  You aren't "earning" it now.  

Facts are cheap...knowing how to use them is precious...

Thank you so much for your answer! Does this mean that I should put "$0" for Part 6, item #7, and then later on Part 6, item #24.a, I would include the IRA amount in "Total Income" box? On my tax transcript, the IRA shows up under the "Income" section as "Taxable IRA Distributions" and then the figure is included in "Total Income" at the bottom of the "Income" portion.

Information for the three tax years is entered as the number on the "total income" line for each of the years.  None of that is "current" unless it is self employment income.
