H1B1 H-1B1 for Chilean and Singapure Citizens

Hello community

I have several questions regarding this visa. Unfortunately, is a specific visa only available for Chilean and Singapore citizens, and not so many lawyers know about the visa.

I already got my visa approved. But the processing time took so long, that my employer decide to hire someone else to take my position in the company 2 days before my visa was granted.

My questions are the following:

1.- Can I travel to the US to sell my car, and close my bank account using this visa without working inside the US? (Apply for the ESTA is impossible, as I got refusal twice last year) (Apply for a B1 visa is impossible at this time, as the nearest appointment for B1 in my country is Dec 2024)

2.- Can this visa be transferred to a new employer? UCSI website said yes, but how long the process would take?

3.- Do the new employer will need to submit an LCA?

4.- What document will I need to submit in order to transfer my H-1B1 to a new employer?

5.- What would happen if the employer who backed up the petition of my H-1B1 does not submit the I-9? I am allowed to submit the I-9 form myself?

Hoping someone can give some recent feedback about this visa and the options I currently have.

Many thanks in advance!

Cheers!

You may use a visa only for the purpose for which it was issued.  For H-1B1, that means working for the employer that filed the LCA for you.  If the CBP officer at POE asks what company you will be working for, you cannot truthfully declare that you will be working for a company if they had actually cancelled their job offer to you.  In the first place, you cannot even truthfully say that you will be working.

1.  You cannot use this visa to enter the US at all -- it was issued to enter the US to work at a specific job.  As that job is no longer available, the only way you could enter the US with your current H1B1 visa would be to lie to the immigration officer, saying you were entering to start your job.  Lying is never a good idea!!

2.  The visa is not "transferable".  You would need to apply for a new H1B1 visa.

3. Yes

4.  No documents will "transfer" your visa.  You will need all of the same documents from the prospective employer that were submitted to get your current visa.

5. Not sure I understand this question.  The I-9 is used to document a new employee's identity and work authorization.  There Is no repercussion to the company for not submitting an I-9 for someone whom they do not hire.  There is no pathway for an individual to submit an I-9 personally.  How could you possibly submit it personally on behalf of a company that didn't hire you?

I appreciate the information.

I talked my case with a lawyer and my employer-backed up my job offer last minute.

If someone needs advice on an H-1B1 feel free to quote me and I will provide the lawyer information,  who answered all my questions in a diligent and accurate manner.

So your employer is ready to give you that job? In that case you can go to the US for sure and it has nothing to do with the lawyer you asked. He can't do anything if your employer doesn't accept you.

Uptade:

I landed yesterday into the US.

The facts: My visa expiration Date is: 08 March 2024 (H-1B1 visa)

The LCA is valid until 31 March 2023

The official at the POE told me "I refreshed your I-9 and you can stay lawfully until X of April 2022" ....

There's any website I can visit to check until what specific date I can stay lawfully inside the US without problems?

Many thanks in advance!

Hello,

As Jota stated, Although not many lawyers/recruiters are aware of the visa, I see numerous potential positions accessible for my experience. So, could you kindly recommend an appropriate job agency or recruiting consultant to contact?
