Timeline

I would like to know if a person could push for an interview under the fact of this backlog and that my husband and I are running out of time to have a baby thru ivf and has causes us issues, they are with holding our right to have a family some please advise us im almost ready to push they are violating our rights as a married couple our interview is supposed to be in ghana

I'm not sure this would work.  Would it be possible to do IVF in Ghana?  That way, you can continue on your plan of starting a family without having to wait for US immigration?

I agree, this would be a stretch, but you can always try for an expedite.

Not a valid reason for an expedite *in immigration’s eyes*. It’s free to send an expedite request but I wouldn’t have my hopes up.

they never violating your rights as a married couple, many people are on the same boat.

perhaps go to Ghana and have IVF there?

They are not violating your rights.  I'm sure you can find an attorney who would take your money, but I'm not sure you would be successful.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Hi there! Sorry you’re in a tough spot. You can certainly try, but I’d be weary of any attorney taking your money to try this. It’s a long shot. While I do understand wanting to have a family, it is not an immigration right. Plus, they can easily say that you can try that in another country. 
They are not violating any right.

Timeline

Have you tried to file for an expedite.  Your MD will need to write a very detailed explanation of why it is an emergency.  Also, if expedite is approved, it still can take another 2-3 months before an interview can be scheduled, and your spouse will still have to go through AP.

The thing with expedites such as yours is that I bet you money there are hundreds of couples in the same situation. I know it sucks, trust me, I understand you, but IVF is not listed as a humanitarian reason for an expedite unfortunately. Straight from their website:

  • Emergencies and urgent humanitarian reasons;

In the context of an expedite request, humanitarian reasons are those related to human welfare. Examples may include, but are not limited to, illness, disability, extreme living conditions, death in the family, or a critical need to travel to obtain medical treatment in a limited amount of time. An emergency may include an urgent need to expedite employment authorization for healthcare workers during a national emergency such as the COVID-19 pandemic. Additionally, an expedite request may be considered under this criterion in instances where a vulnerable person’s safety may be compromised due to a breach of confidentiality if there is a delay in processing the benefit application. A benefit requestor’s desire to travel for vacation does not, in general, meet the definition of an emergency.

OP has been denied for medical reasons in July , it seems ..not sure if she appealed that denial or what the medical reasons were. 
There will likely be a rough interview, if there is a big age gap , so hopefully she can go visit often before they schedule AND fly out for the interview itself..to avoid getting intentional and additional delays.

First of all, I sympathize with you. Been there, it is so painful. Husband is also from Ghana and we asked for an expedite for the same reason and were denied. We even got a letter from my doctor stating the importance of the expedite.

 

On a different note, IVF is also very expensive, even in Ghana. People here are telling you to have the IVF done in Ghana but you need to look at the different IVF clinics statistics i.e. overall success rates, success rates by age, fresh eggs vs frozen, etc. I would consider having sperm frozen and shipped to an IVF clinic in the USA or Europe. Again, this is all very, very, expensive but it might be the best route for success. If you haven't already, spend time researching the IVF process and know the costs and chances of success before making any decisions.
