6 months visitors visa running out while waiting on E2?

Fly the Canadian flag ( flag n VJ ) for a bit..lots of threads in the employment forums, so u may connect w an attorney referral from someone.

 

As Canadian your door just opened wider and many many navigate the E-2 without hiccups.

Yeah sorry I don't know how to change the flag. 

 

So yeah coming in with my wife as a visitor, then buying/leasing what needs to be done after registering a LLC for that state. 

 

Hiring 1 person for sure along with 2 others if needed. To expend the business. 

 

Getting a office location for sure. And renting out some kind of storage place for all my products that I would be selling. 

 

And that's pretty much it. I was told you can file after 90 days of entering and just last night after posting here I just got word you can do some EXPRESS or whatever it's called to get an answer within 2 or 3 weeks or less if you pay extra for this type of service. 

 

That's all sorry to sound stingy with the details. lol Sorry about that.

I would be hard pushed to think of a good reason to change status when you are not even in the US.

 

Much simple to get a E2 Visa from Canada at least that way you are not landlocked.

 

A lot of Lawyers do E2's, and not as if you need to visit them, Immigration Law is Federal.

 

E2 is not simple, well it depends on the nature of the Business, some are pretty much a shoe in others marginal.

Roughly how much would you be looking to invest?

I don't mind being landlocked at all. It's only for under 1 year term.  From start to finish 4 or 5 months tops? 

 

So if I get approved I'd still need to do a change of status on visiting to E2? Or doesn't apply to Canadians?

Yes the office + storage will be probably less at the very start until I grow it to a good level after sometime. I am looking to drop $150k in total because I still have to send the money to buy the products in China.

 

I can do as high as $400k. But that's a bit risky. Baby steps! $150k is fine I believe. I could be wrong. If so it's fine to be wrong but costly in the end right?

That is different again, not sure I have seen an E2 for just that period, perhaps there are better options. I would start with discussing what you want to do with the Lawyer and go from there.

Oh yeah I spoke to him today and he explained to me more in details. I was just getting worried because of other info given by others here on the site.

E2 is an investment visa, I think that is your big problem, if you are going to be here a few months then the Investment side sounds minimal, more like renting some space and just one temp employee.

 

The Lawyer I assume knows your Business Plan and would be interested in what they say.

I plan on investing a large amount ($150k) If it's to little then I'll just buy the warehouse but if I am spending $500k+ then just do EB5 but that's down the road I plan on growing this business. But first I wanna get my foot in the door and start.

 

If you see problems with it let me know. Because most get approved with under $150k. So need more and hire more folks is what you are saying?

I am confused, your Lawyer has the big advantage of knowing the full deal and I can see why you would not want to share than on here.

 

A lot of this will be down to your Business Plan and I thought you would only be here for a few months,

 

EB5 is a whole different situation and implies you are looking to move permanently.

So new info now is if I leave the country after getting approved I lose my E2 status because it was filed inland while in the USA. Rules!!!! Blah. I guess better to do it from outside and it's a 4 to 6 month wait only. Seems less complicated and less bs to deal with.
