Proof of Income/ Support for K1 Interview

Just wanted to confirm that there is no requirement to complete the Affidavit of Support (I-34) for London K1 visas if you are able to show proof of assets/ self sponsor? I have bank statements from the last 3 months showing my savings and also a letter from my fiancés employer stating his employment and annual salary - should this be enough?

I believe you will still have to complete the form, never heard of it not being required. It has a place where you can include your assets on them if you are just using them to qualify. You wouldn't need proof of employment or anything if you are just using assets. Plus, it gives you a little practice for the I-864 you will need when you AOS. But you have the proof of employment from your fiancee also. Whoever filed the K1 ( US Citizen) is the one who has to complete the I-134, not the intending immigrant.

To self sponsor, you show proof of your assets. Your assets goal might be 3 times the poverty level. So if that’s just the two of you (no kids supported in household size) it’s around $60k in USD. Here’s the poverty guidelines https://www.uscis.gov/i-864p 

 

You do not need an I-134 if self sponsoring like this. If the document collecting person asks for your I-134, just say I am self-sponsoring. They are just used to collecting an I-134 and may ask out of habit. If you have asset accounts at multiple places, it would be helpful to make a summary spreadsheet for the officer showing bank name, amount in £, then conversion to $. Then a total line of all assets. Bring the financial statements that prove the amounts.

 

If you are going to use your fiancé’s income, then he should fill out the I-134 and include his employer letter. A K1 in London does not have to provide a tax return if they have another way to prove income like the employer letter.

 

However, with all that said, the decision on a K1 is subjective. There are no hard rules like the I-864  and the 3 times poverty level needed. As long as the officer feels like you will not become a public charge, he can approve. I have seen self sponsor people report they were ok with $40k. And if you just show the employer letter to sweeten the pot, the officer might be convinced.

 

But don’t forget, there is another Affidavit of Support when you adjust status after marriage. That’s the I-864 with the strict rules.
