K1 Marriage visa and questions

Hi everyone,

I’m after some advice before going down the marriage visa process. If anyone is willing to share their experience or just happy to answer questions I have that would be a huge help.

My situation is as below.

I have been with my partner for a handful of years now. She is American and I’m from a Southern Hemisphere country with a good relationship with the US.
I had a 2.5 week overstay a few years ago at the end of my J1 visa but have been back a handful of times now on the B1/B2. Only once getting questioned on entry but letting me go through. 
We are planning to get engaged soon and married in 2024 and then apply for a marriage visa. We are both living in my home country until we get married. 

 

I understand it may take 1.5 - 2 years from the time we get married but we are ok with that.

What course of action is best to take going forward?
What have peoples experiences been with the process, the interview process and things to look out for?

Appreciate any help!

You would probably receive better answers if you reveal your home country.

Direct Consular Filing is the preferred route if you qualify.  You can't start the spousal visa process until you marry.  The visa queue is not getting any shorter.  Good luck.

Senior Master Sergeant, US Air Force- Retired (after 20+ years)- Missile Systems Maintenance & Titan 2 ICBM Launch Crew Duty (200+ Alert tours)

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I suggest you read the guides section of this web site.  Your title mentions a K-1, but a CR-1 is a spousal visa.

What do you mean direct consular filing sorry? There are other ways of filing by the sounds.

Once you marry, if your wife has to move back to the US on short notice, typically due to her current job transferring her, then you may qualify to Directly file with the consulate and bypass USCIS.  Direct Consular Filing.

 

DCF is handled on an exception basis.  If you are not in a hurry, then plan for normal spousal visa processing.  Sit down and talk to each other about when you'd like to move to the US.  If that date is 2 years from now, then marry soon and have her submit a I-130 for you.  If it is sooner, then marry right after you read this and have her submit a I-130 for you.  If it's 3+ years out, then marry about 2 years before you want to move and have her submit a I-130 for you.

Correct.  Not sure why anybody would even mention DCF unless exceptional circumstances were mentioned.

Facts are cheap...knowing how to use them is precious...
