Hi all.  So we're nearing k1 approval hopefully (expected in the next month). So then we know we need to wait for the interview, get the k1, etc.  But looking ahead to the AOS, we're wondering if there's any precedent for that speeding up if she has a job offer?  For some context, she's a professional (think doctor, lawyer, professor) that has a doctorate from the US previously ... so there are jobs that she'll be able to line up quickly.  But it's going to suck to have to wait ~1 year for the AOS/ work authorization (we're in NYC, where it's super backed up).  We heard anecdotally people getting a job offer and using that to pressure the AOS faster... but what does the VJ community say?

Thanks.  Appreciate the clarification on the EAD vs. AOS.  That's fine, that achieves the purpose.

 

Re: EB1, this industry doesn't historically get them for this specific focus area.  Sucks.  If we knew the K1 was going to be so delayed, we would have worked through h1b and even switching jobs to someone who would sponsor an L visa.  But now we're too far down this path... so just hoping we can get her an EAD and also ability to leave the US within a short-ish timeframe after coming.

Sadly, they're not going to expedite her AOS because she's a professional. She's isn't the only professional undergoing immigration process. The only thing you can try expedite is EAD but that too is a hit and miss. 

 

Unfortunately, this is one of the downside of K-1. Had you gone CR-1, you wouldn't be dealing with this. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

As mentioned by others, you should be fine w EAD expedite if she has a job offer.

 

Linking this post , where OP requested AOS expedite because job offer ( pilot) required her to have LPR status, not just EAD/AP…let’s hope @Bieloanya checks in :

Taking up to 8 months currently.  If work and travel were priorities, CR1 would have been the better visa to choose.

Anecdotally, I have seen successful expedites for EAD and AP in the last few months, but AP seems to be the trickier one to get.

It might not be a thing anymore but back when I expedited my EAD I received a combo card that also served as AP.

I noticed that many people on here don't update their timeline for AP but only for EAD when they received a combo card. Or maybe don't really look at it and have an AP without knowing 🤷‍♀️

I think that has changed somewhat since they decoupled EAD/AP processing in February. Certainly a few people in my AoS month only got EAD expedites. Doesn’t make any sense to me but they work in mysterious ways.
