Hello all, I wasn't able to find any info on this edge case with a search of the forums and am hoping you all can provide some insight.

 

I am a USC and my wife is applying for naturalization (N-400). The application asks for a certified copy of her birth document. Because her home country doesn't issue a birth certificate per se, the document we received lists a bunch of extraneous information, including her marital status. Because my wife has a publishing career under her maiden name, we have not yet registered our marriage in her home country, whose laws require that she either take my surname or hyphenate. As a result, her birth document lists her marital status as 'Single.' We have a wealth of other evidence showing that our marriage is legitimate, but I wanted to ask the community to see whether anyone had encountered something like this before we take any excessive risk by applying for naturalization using that birth document. Our other option would be to declare our marriage in my wife's home country and deal with the consequences of the unwanted name change as best as we can.

I’ve never heard of the LPR being required to provide a birth certificate of the applicant. 
 

Anyway if it complies with https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country.html then you are good.

Can you please point out where exactly do you see this requested on the application form?

 

You only need birth certificate of USC or their naturalization certificate (if applying under 3 year rule) and birth certificates of children in marriage (3 year rule application)
